Default Chris Walter of Get Bent Charters (Islamorada) took my $200 and won't give it back

It’s been more than a month since my family visited the Keys for a vacation of relaxation, snorkeling and fishing. Although the trip was terrific, I have been reduced to calling out a captain on the internet because he won’t send me my $200 deposit back after he cancelled our offshore charter because of wind.

Here’s the story: We originally booked a six hour offshore trip with Tom at Dooda Charters on Tuesday August 3 but Tom quickly realized he would be on vacation that day so he referred us to Chris Walter at Get Bent Charters out of Islamorada. Our initial conversation went well and Chris asked for a $200 deposit which I sent to him and he cashed immediately. No I didn’t get anything specifically in writing about the deposit, other than our agreement over email. I figured competition is so intense in the Keys that it was pretty cut and dried about when a deposit should be refunded. Certainly the captain cancelling because of weather qualified. Or if we didn’t show up he could keep it. Next time I will get it in writing.

Well when the Monday before the Tuesday charter rolled around and we were in the Keys, it was very windy. Some of you may remember it. At 4 pm Monday I suspected the wind was going to submarine the trip but I had heard nothing from Chris. So I texted him. We talked on the phone and he rightfully cancelled offshore and offered to do some reef fishing. My family has done a lot of that so I declined and asked if Thursday offshore was a possibility if the wind died down. Chris said he was already booked Thursday but he referred me to Capt. Rick Kilgore. Rick and I never connected and I had to go ahead and book with Capt. Anthony Whitford because of time crunch.

Over the next week I texted and called Chris several times about mailing back the $200 but he would not respond to texts or take my call. It was interesting because he had always been prompt to respond prior. When Chris finally took my call (no doubt on accident) on August 8 he yelled at me about how he tried to arrange another charter and that it is only $200..Finally after ranting for a minute or so he said he would put a check in the mail “tomorrow.”

The check had not arrived by August 19 so I texted and emailed Tom at Dooda Charters and asked him if there was any way I could get my family’s money back from Chris. Being what I consider a stand up guy, Tom said he called Chris and Chris said he was sending the money.

Well, here we are more than three weeks later and I have not received the $200. So this is my next option I guess, publicly calling him out. Does anybody know this guy? Any comments or suggestions? Can I pursue this from a complaint standpoint with Coast Guard, FWC or Marine Fisheries? Locally?

Of course if I do receive the money from Chris, I will immediately post that he made it right.

NOPE, no recourse there.

His web site says full refund for weather cancellations. He offered reef fishing and you elected not to do that. You wanted and booked an offshore trip, not reef. If that is what was communicated then he could not provide the service safely that you put the deposit down on.

HE CANCELLED

He owes you 200 bucks.

In 20 years the only deposit I have not returned is for a no show or last minute cancellation due to more times than not hung over clients.

If I cancel due to weather I try my best to get you fishing if possible at a later date or do something different to get you out. If it is not what you want, then you get your money back and if your at the dock we will go have some breakfast and make some plans for next time.

Sounds like a DB to me. Send him a link to this thread. Hope you get your $$ back. Too many good charters in the area to deal with people like this.

He probably thinks because he offered a reef trip and you declined that that you canceled the trip. I am not saying what he did was right just trying to think of why he thinks he does not have to return the money.

From your account of the story, it sounds like he admitted to owing you the money.

It's just a matter of you getting paid

Sucks

I'm out $2,600 for a charter that I foolishly pre-paid for because I considered the captain a friend. He cancelled for weather the first time but ran another trip, then twice for mechanical issues and I found out he ran trips. He's had my money since February 15th. I've disputed the charges with my CC and was told 60-90 days. I'm almost 60 in so maybe I'll get it back soon.

I'd call Dooda and let him know about it...I am sure he's not happy someone he recommends is screwing people....I rarely recommend people for that exact reason

I'm not sticking up for anyone but I think calling someone out on social media is a poor choice (especially on your first post).

There's a large chance that this isn't the OP's "real" first post. I'd be willing to bet his $200 deposit that it's a member who didn't want to be known as "that guy" and opened up a new account.

With that said, I don't blame him for the call out. What a douche to not return a deposit because of a weather cancellation.

I got up one morning to go tuna fishing with a "friend". Told me to be at the boat at 4am. I was there at 3:30am...that douche was already out the inlet. Not exactly related, but I do hate a douche...and they are all the same.

Small claims court or first call the Sheriffs office there and explain to them. I had a similar situation with a contractor and a door installation and the Pinellas Sheriffs office sent a Deputy to talk to the guy and he instantly contacted me and promised to send a check.

If everything is as you posted, I like the idea of sending him a link to this thread. That's real bad business, you should also go the big Florida fishing website and post it up there (I can't remember what it's called).

His real names is at the bottom of the letter. I don't think he is trying to hide his identity.

He has to have seen this thread. I can't believe he hasn't returned the money. Ruining your reputation over a couple hundred dollars is just insane.

I will definitely make a mental note to put this guy on my "do not call" list. Pretty douchey to promise to return $ and not do so.

There are two sides to every story. Chris is not only an exceptional fisherman but he is a good guy. I'm sure there is more to it.
