Oh boy, that's not good. I guess the guy in the pilothouse is afraid to back off the sailboat in case he has a hole in his boat.

Captain: "Oh shiz I screwed up and drove over your sailboat, you mind if I just leave my boat here in case there's a hole in it"

At this point, would you consider that sailboat to be operating 'under power'??

Guess the guys in the power boat didn't know

(a) A power-driven vessel underway shall keep out of the way of: (or off the top of)

(i) a vessel not under command;
(ii) a vessel restricted in her ability to maneuver;
(iii) a vessel engaged in fishing;
(iv) a sailing vessel.

so if that pilot house was going 35 or 40kts with no one at the helm would it have jumped that sailboat?

My bet is yes. This guy is a light tackle guide and my guess is he was going 10 knots or less looking at this electronics trying to put his charter on fish and wasn't paying attention to what was in front of him.

He's a licensed charter boat captain. I'm sure he knows the rules of the road. My guess is distracted driving looking at electronics as opposed to what was in front of him.

Oh yeah, at 35 or 40 you'd easily clear it. I'd guess he was trolling.

That is inexcusable. Clearly the fault of the captain on the powerboat. One of the first things I learned when operating boats was how to tell if you were on a collision course. If I were on that sailboat I would be on the radio, shouting and blowing an airhorn once it became obvious there was no one paying attention at the helm of the powerboat. At some point, you need to suck it up and tack away. Also, I have a hard time believing the power boat would end up on top if was only going 10 knots or so. I hope no one got hurt!

As I understand it he was running back from fishing, so he was most likely on plane and at speed.

I've had a sailboat tack into my course before. All was clear, then blink, and the thing has turned right in front of me. Did not hit, but too close for comfort.
