So, with the regulations being evasive/blurry at best, my question is if you catch one, get it to the boat and itís dead, do you just have to cut it loose and waste the fish? I know the season is closed but thereís something about an incidental bycatch law and not targeting them. So who knows the details on this?

If the season is closed and the fish is dead, watch it sink down to the sharks. The incidental by-catch regulation refers to it being unlawful to target them. If you accidentally catch a "trophy" (73"+) while the season is open, you can keep the fish.

Was commercial open? Does incidental apply to commercial?

One Capt in the group had on Facebook said they were done for the day and was dumping out the chum and the bluefin came to the top so drop in the yellowfin rod and popped off fast so they grabbed the sword rod and drop a bait and hooked up and a couple hrs later got popped off . How is that incidental when you hand feed them off the side the boat? I would have done just made it sound incidental

OK, I'll poke the elephant in the room since they have videos and dark web postings. Was it legal? The video I saw was not a charter. Commercial fishing? Different rules?

And that post was quickly edited to remove the part about getting busted off then grabbing the sword rod, cutting the deep drop lights off of it then using it to toss a bait to one of the bluefin. If youíre gonna do something like that, why the eff would you post it on social media and take a chance at steep fines and losing your charter license/livelihood??? Dumbasses.

As others said, the article explained that they were done fishing and tossing excess baits overboard when the bluefin showed up. Then they hooked one, and then called the other boat in, which then hooked and landed one as well. That's targeted fishing. The fishermen can get whacked for this.

Look up the precedent set by the judge who oversaw that last case where a Venice guide killed a bluefin out of season and then destroyed evidence. The punishment was so light it was mind boggling. I agree that they were targeting them. While I can say I probably would have done the exact same thing, I would have kept the video private and my goddamn mouth shut.

Everyone might as well fish for them (incidentally of course) if there is no fines involved... FTF
Congrats to the crews!!!

So 2 targeted and one caught after the season ended. These three illegal fish caused the season to be closed and honest incidental catches now have to be released.Nice work.

Not jealous at all. A little concerned that experienced captains would post the chum video and another angler/captain experienced enough to land one would do so after the closure. This will not endear rec fishermen to NOAA. Not that a love fest existed before. For sure the quota next year will be 1 less fish if they even have a quota.

Theyre poachers and stealing from the public, plain and simple. Fine them, take their liscenses and confiscate everything used in the commission of the crime. A professional guide should know better.
