Because COVID-19 continues to impact Florida, a new Executive Order has been enacted to reflect direction from Governor DeSantis, the DOH and the CDC. Effective immediately, all recreational boats must be at least 50 feet apart. Each recreational vessel must not have more than 10 people on board. Full details and additional proactive measures the FWC is implementing

Although not a law, orders passed under the declaration of emergency have largely the same effect as a law. Violations of orders passed under the declaration of emergency are punishable under Section 252.50 of the Florida Statutes as second degree misdemeanors. Interestingly, Section 252 is part of Title XVII of the statutes which is titled "Military Affairs and Related Matters."

Just pisses me off the lawful order as in the video I shared makes people think they can be so tough.

Have your day in court and win the judges decision. That video posted could have gotten that dumb ass arrested. STUPID STUPID STUPID.

He asked about Marshall law and that is when they should have shot him right between the eyes so he could understand what that law is.

You do realize that fat ass could have just obeyed lawful orders and not got the attention he wanted and maybe lets us smarter folks still use our boats.

Those complying and watching should have beat the shit out of him soon as the officers left.

Freedom comes with responsibility in many degrees.
The lack of personal responsibility and hiding behind lawyers and the constitution is why we are where we are right now.

My guess is he will have his day in court and waste a bunch more money and time to prove his point.
On second thought, he will waste a bunch of tax payers money!

w/ a second station as well: I wonder if they purchased this boat from Gause ( like you said, near $200K) or if it was confiscated from criminal enterprise ? That was my 1st thought when seeing this post: Interesting law enforcement ride... must be nice to run that sled.... when law enforcement runs boat that are nicer than 80% of boats on the water. Wonder what the story is...

You gotta love how people don't even read something that they are supposed to comply with. That's why the sheriff has to be out there and explain things to people. Many states are banning activities for that exact reason.

The Gause wasn't a confiscated boat. My understanding is that it was ordered by the Sheriffs dept.

The boat was some kind of special deal but I don't remember the details.

To be honest it probably is no more expensive than a twin engine Contender that can't get to places that Gause boat can. That boat is designed to get to many shallow areas that the agency is tasked for patrolling.

Figured that was the case since I saw there was no livewell in the transom or leaning post. I'm sure David made them a deal. Good looking boat and good exposure for his brand. Hope you are doing well Troy.

I am fairly sure David did this as a promo back before his brand got really rolling. He was actually doing a few boat shows back then.

This video is so disturbing on many levels. If you wonder why the next LEO might have a less than stellar disposition.. It’s likely that he’s dealing with guys like this asking so many dumb and inflammatory questions. They did not make the laws or orders.. They are being asked to enforce them as a part of their job, albeit somewhat loosely. Give them a break with some understanding. Should they have closed down the boat ramps - hell no. But people should be abiding by the orders/recommendations. Not sure where this was filmed at but PB, Broward and Dade almost have 1/2 of the cases in Fl. If the infection rate does not slow there I suspect closed boat ramps and 10 person / 50ft rule will be just the start of the sacrifices. There are so many places to go with your boat, finding a spot 50 for from another boat is easy. Off my soap box now.

For the record, I don't have heartburn over the theory behind the dispersion rules put forth by FWC. I can see the need behind it and recognize it as a lesser restrictive alternative to other approaches the government could have taken (such as closing the ramps).

Based on the NPS Ranger making reference to Johnson Beach, the video is almost certainly from the Perdido Key unit of Gulf Islands National Seashore.

I agree that knee deep in the water with the cops is not the place to debate the validity, advisability, or alternatives to an order such as the one in this case. Like you said, follow the rules, color inside the lines, and if you think things should change then address the people who can make the changes through normal channels during regular working hours. At the risk of being painted by some as a person who hides behind the constitution, the legal side of this issue is that challenges to some of these rules can't be made unless someone has standing to do it. For something like this, the only way to get standing is to get arrested. Maybe that's where the guy was trying to go with it; some kind of legal martyrdom.
