Default Coast Guard refuse to move a boat blocking a marina

Palm Beach, FL

For months there has been a derelict sailboat moored about 60-70’ in front of our marina. Nothing was done by any law enforcement. NOW, since a ten minute squall three days ago, that same boat is 25-30’ directly in front of our slip and the neighboring slips. Completely blocking access to and from the marina on outgoing tide (on flood he faces the other way and is 60-70’ away).

I have called the PB Sheriffs Office - they came out and wrote him a ticket for expired registration ($40 and he won’t pay it). “There’s nothing we can do.”

I called FWC (The bottom is State property) - they haven’t even come out.

I called the USCG - First day they didn’t even come out. Second day they had a boat come by. Their RIB couldn’t even fit lengthwise between our boat and the sailboat. “There’s nothing we can do” and drive off. I called the watch commander “Unfortunately there’s nothing we can do.”

ARE YOU F-ING KIDDING ME?!?!


There are laws on the books that say you cannot anchor/moor in a channel or fairway to/from marina. There are laws that say you must get a state permit to set a mooring (this is a mooring this guy’s friend set illegally). There are laws allowing for the removal of derelict boats. There are laws regarding waste - these guys dump their crap buckets in the harbor. “There’s nothing we can do?”

I GUARANTEE if this guy was fishing in the snorkel zone 100’ away he would be dragged off. I GUARANTEE if he was anchored in front of the CG docks he would be dragged away. If he was anchored on the reef (instead of mooring balls) he would be dragged off. Can you imagine what would happen if he was moored IN SIGHT of Mar A Lago?!?! The 50 Cal’s would be UNLOADED on him.

I have always tried to support law enforcement, especially the Coast Guard, but this is RIDICULOUS!

I agree other than this is a state issue, not a USCG issue. Press FWC to do something.

If it was blocking my coming and going I would move the mooring and boat back to where it was . Either with (if the owner is around) , or without the owners help . It doesn't look like the owner can/will move it himself .

Your first and biggest mistake was posting about it here instead of just taking care of it under the cover of darkness. Either way, you know what needs doing, but now there is a trail that leads back to you.

I can see where this is NOT a USCG issue, but I would think the local Sheriff or FWC would have some authority. If there was a derelict vehicle on the side of the expressway, who would order it to be towed out of there?? I would think similar authority would apply to the state's waters.

If they are dumping buckets of crap then you should get that on video and turn it in to the FWC... isn't that illegal too?

Do the right thing and move it for him...to far away, just visible from the marina. If it dragged anchor once, it will do it again and might damage your boat.. therefore "Probable cause". You and some friends dress like Indians and do it at night. I understand there is precedent for that kind of thing ;-)

Sounded like the sailboat was a problem until I saw the picture, then I realized what the problem was. Perhaps you and your slip mates could get a group discount on a boat handling course if you all consider yourselves completely blocked.

So, CG can't do anything, P.D. can't do anything, and FWC hasn't responded yet?

Give FWC another call and get them to tell you SOMETHING (after they look at the situation).

DEMAND one (or all) of the three to tell you WHO can do something - SPECIFICALLY - name, organization and phone number!

Hard to believe (but not TOO hard) that this kind of crap takes an "act of Congress" to resolve? ;?

Isn't like this kind of nonsense hasn't happened beFORE!

Give everyone involved ONE week to respond with a REAL, LEGAL answer.

After that - things go bump in the night.

Sad.
