Bullshit. He bought it and has a receipt. At that point it was his. He had "possession". Lowes had no right to re-sale a vanity that was no longer theirs. They actually sold his property which may even be illegal. They owe him a vanity.

Corporate is just around the corner. Our local airport houses the fleet. Let me know if I can help.

i disagree. He never took possession to complete the sale. Loweís screwed up but did nothing illegal. They should make it right within reason.

I think lowes sold stolen property. He didn't order it. He brought it to the register and paid. He owned it and they resold it.

This is something people do all the time. I've often seen carts full of merchandise marked with someone's name at the local HD. I bought a closeout deck furniture set once that I wasn't planning to buy, went home to get the SUV. When I got back the guy had partly disassembled things for me and packed up the tiles that cover the tabletop, as one might expect. He didn't resell it to someone else nor did he let some crook walk off with it.

OP is owed some kind of accommodation by the store.

I had a similar issue with a boat builder ! They had a finished boat .on consignment it had been paid for and not picked up
Told builder and owner of boat I would buy it . All agreed , Price agreed on etc , Thought I could trust these guys , thier
word was no good . I needed a couple of weeks to shake the trees for the $$$ . Boat had been sitting for a year , I figured a couple
of weeks would be no problem ...

So the few weeks passed I had the cash , boat magically disappeared . So I bought a boat from a competitor . It came down to trust
I trusted them , they did not think I could raise the money ... They claim their customers are "Family" Well that's a hell of a way to
treat your family ...

Dude I feel your pain ...

How does an item that has been marked sold and has a receipt and bill of sale taped to it get resold? Did someone remove that information? Or did an employee resell it with that info attached to it?

No dog in this fight but I would imagine if you present all of the information to the manager they will make it right, a few hundred sheckles is nothing to them and they want your biz back, good luck either way.

what a load of crap.

i mean thatís a classic case of ďmoney talks.Ē

You can talk until you are blue in the face about how you are going to come up with the money, but the second someone walks in with the cash in hand to purchase it, itís gone.

Any legitimate business would do that. Itís not about trust, itís about selling the product.

You can act like a bitch about it all you want and proudly buy something from a competitor but I bet the first company couldnít care less about your rapid nose breathing and clenched fists.

Did you read the "all agreed" part? They broke their word for the almighty $$$. That's pretty low class. They should at least given him a call and told him what was going on.

Riddle me this. You go to buy an item off of Craigslist for $100. You pay the guy cash but donít take the item as you need to come back at a later time. Guy then sells item to another person who showed up and offered more. Guy hands you back your $100. Did he do something illegal? Does he owe you more than the refund? Does he owe you the same item from somewhere else?

In VA oral contracts are as binding as written contracts so yes and yes.

I haven't read all of the following replies BUT,
maybe the same cashier pocketed the money from the 2nd sale?

Leverage goes to the OP. A dialog with the Lowes manager informing him that the houseful of other items purchased at his store will be promptly returned if he doesn't produce a like vanity will likely achieve a positive outcome.

Found myself in a somewhat similar situation at Home Depot where a lawn mower was 3 days out of warranty when I noticed the engine had cracked leaking oil everywhere. The manger was quite nasty about it with a "sorry but that's too bad" attitude. I said ok, reached in my pocket and produced $3800 worth of receipts (washer, dryer, dishwasher, fridge) purchased a week before for a remodel. I showed him the receipts and said I'll be returning these items this afternoon. The manager developed an immediate sense of compassion for my situation saying "you know that crack probably started a few days ago while under warranty" There was a new honda mower being loaded into the back of my truck before you know it.

yes, yes, and he could be liable for a bit more than the same item from somewhere else

you obviously do not know what a contract is, written or oral
