Default NY Speeding ticket - wrong info on ticket

I got a speeding ticket in Staten Island. It was a Sunday morning around 7:30, empty expressway. I was doing 70, in apparently a 50. 4+ lanes usually means 65 in my head. I am sure I missed a few 50 signs somewhere along the way. I was 100% speeding. Typically I will just pay speeding tix, as I deserve it. I am having issues paying this one. For one, the cop was a dick. And really fat. (how are there fat cops?) . It feels like a little discretion could have been used.

I went to pay the tix about a week later, but for some stupid reason they print them on thermal paper and I had left it in the car, so it was unreadable. I just got the nasty gram saying they suspended my license in NY, which I typically wouldn't give a rats ass about. However I am in NY at least a couple times a month. This could be an issue. So I went to pay it online. I can't because it looks like the guy entered my wrong birthday. Is this enough to get out of the tix? I really do usually just pay this stuff, but I really hate giving NY more money and even though I broke the law, it was just a stupid ticket.

Get a lawyer and fight it. With the wrong DOB on the ticket you may get it thrown out.

When I get speed tickets from NYC, I hire a lawyer http://halturklaw.com

What we do, he makes it for final 3 yrs away, then I pay the fine, and no points

He usually only charges me $350

Might be able to, but usually the intent of the officer writing stuff on the ticket was enough to make the ticket stand, best case now is lawyer up and get your ny standing in good status. Pretty sure the power of the internet means other states and your insurance will know about this shortly.

[In GA] harmless error can be amended and the prosecutor can draw an accusation, do not need 'ticket". I get them all the time wrong color car, wrong tag, wrong date, wrong time, etc.

i remember most of it well.

I was 17 or 18, driving to HS. some back road, town of poughkeepsie, ny.

got pulled over doing 56 in a 45.

cop put wrong DOB and wrong road name on my ticket. hand written, no thermals yet.

i don't recall the amount, maybe $75 or something. my dad said you either pay it or go to traffic court and try to fight it. maybe the cop won't show... used to be an auto toss out.

any way, i choose to fight it, got nothing to lose but $75 and some extra yard work. my old man takes me to traffic court and the officer is there... "great" i'm thinking

judge calls my name, I walk up, he asks me about what happened. I tell my side and mention the info on the ticket is wrong. just asked for the right info, i tell him. judge turns to the officer and asks if this is true. officer says ' i guess so'... Judge pauses, says dismissed, slow down. goes back to the cop and says how are you going to make detective if you can't write a ticket properly?

dad and I smiled and left.

Not too worried about the points, NH really doesn't reciprocate with other states. The fine is only $230, not sure it merits a lawyer. Sounds like I'll just be paying it. Pisses me off, it was a BS ticket.

To add insult to injury I was driving my kids to their Moms as a favor to her because she didn't feel like driving. I was driving because the delta flight I was on was diverted to PA the night before because of mechanical issues. Wtf. That's what I get for being a nice guy.

I can tell you what happened to me. I was on I270 in Columbus, Ohio and the stretch of road had been a 65MPH zone forever but the speed was changed to 55MPH and I didn't notice the sign and of course there was a cop sitting just past the 55MPH sign and got me @ 67. The cop was one of the biggest a-holes I have ever met. I told him I had a CCW and he asked me to get out of my car and he put me in handcuffs! He said it was for his protection..... I was so pissed off but I knew there was nothing I could do about it.

I noticed the ticket had the wrong date and wrong color of my car. I decided to fight it and called a friend that was an attorney. He told me that more than likely the court would enforce the ticket from the officer's testimony and it wouldn't be worth the time or effort to fight it.

70 in a 50 doesn't sound like BS.

My experience with SI and tickets....got one, maybe 74 in a 50 and there was a normal fine then I think there was a $600 fee on top of all that which you can pay over time if you want (hope you don't have to worry about that as you're out of state) but nowhere on the tkt did it mention it, I think. Can't remember how I found out though either, sorry.

Called a couple traffic lawyers and both said, don't bother, SI is tough and you most likely won't get it reduced, let alone win.

Move to Texas. Our speed limits are 75 on county roads and 80 on the interstate.

The $600 charge is if you have a certain amount of points on your license. I found that out the hard way.

I believe that's called the Driver Responsibility Assessment. Not that I would know anything about it...

NYC highways are all 50mph, other roads are 25. If you get much north of 60 you are probably going to get nailed.

Actually after the wall came down in '89 speed limits were imposed due to the increased congestion that flooded in from the East. Very little stretches left with no limits. I did three tours in Germany with Uncle Sam and was there when the walls came down, took all the fun out of it.

Normally in New York City incorrect info on the ticket can be corrected by the officer at trial. Since you skipped the trial you are guilty and have waived your objection to raise this defense unless you want to appeal on the basis that you were not the person charged by the officer -- which would be perjury to raise and writing that in a court paper is chargeable as submitting a false instrument for filing, a Class E felony.

Short answer: don't drive in NY again ever, or pay the ticket. If you drive and are pulled over you will be arrested and charged with 511 - operation while suspended.

Or points the tkt is worth.

I hadn't had a ticket in a decade or so and still had to pay the $600 I think because the tkt was worth a bunch of points.

And our water don't get hard in the winter so I can fish year round

Cops come in 3 body types. Fat asses, roid ragers and skinny ****s. The fat asses can't run, the skinny asses are too small to kick ass and the roid ragers are all looking to fight.
