Not if you were a crook.

If I was part of a "swoop and stop" insurance scam I would love to have the Cops help me scam money from honest people for back injury, car body damage, etc... Nothing like a "police report" to help with a fraud claim.

If the cops are going to charge the station owners with a crime for a guy leaving a pump open, I'm going to swipe my card and then wave person after person after person to the pump and charge them 50 cents on the dollar. Who isn't going to take THAT deal?

The second driver might be able to be charged with "theft of lost or mislaid property" (or whatever your jurisdiction may call it of they have such a law).

I wouldn't pay it. Though I don't have too much faith in our legal system, I don't see somebody standing in front of a Judge and admitting to being such a dumb ass. Stand your ground, let them rant and rave, then let them be on their way. At worst, that guy wont be buying gas from you anymore.

First off, its going to cost him over 50 dollars to file a small claims case.
Second , he's going to have to miss work,, and go to court.
Third, he could not prove he didn't pump it unless the next person behind him that did get the fuel told you about it,, then only you would know unless you wrote the persons name down, gave it to the first guy that can't remember to pump his gas, and then that guy got dragged into it.
You should not have paid it. Going to court is not a bad thing if you feel your right. People get so dang worked up over it.
Its where things are decided. Thats all.. Worst case and point.. Judge sided with the dumb a$$ and you had to pay and you missed work.
Thats all it is to it.

X2 They don't convict, but some of them take the stand and lie like hell to help get a conviction even knowing it's just plain wrong, the cop should be out hunting B & E's or murder victims instead of petty stuff he knows nothing of, oh wait, there may be someone out there that'll spank him and send him home.

Are you running a self-serve gas station? If it's the customer's responsibilty to pump the gas, then it's his responsibility if he forgets.

Somebody makes a cash withdrawal at an ATM, but forgets to take the cash. The next person takes the cash and scrams. Does anyone really think the bank is going to give more cash to the first person?

Kinda like the restaurant scam. Two of us go into a restaurant. I order pie and coffee and you order a full meal. You pick up my check, pay it, and leave. I wait a few minutes and then correct them for giving me the wrong check. Go down the road and switch places.

It sure in the heck feels like a scam. No cop unless it was a real stupid cop could or would make that statement. Who in the hell forgets to pump gas? Then drives off and NOT look at the gas gauge? It is an automaitic reflex.

Some more details to answer the questions. The customer bought the gas for his employee, then left and the employee forgot to fill the truck. Called him a couple hours later. after the guy left about 20 miuntes later the next customer pulls up to the pump and inserts credit card and pumps. I believe she thought it was charged to her card.

The original customer comes in and says to me, "What are you going to do for me?" I told him nothing and he bugs out. "I'm never coming back" blah blah blah. I told him that was fine. He told me he was going to go to the cops. I told him go ahead. Most of the time I am threatened with that they never call the police. Well he did. Police called me and ask me to meet him at the station. I of course do. I am sure he is going to hear my side and tell the other guy to go screw. Now for the psrt that pisses me off...

The police officer, who clearly loved his authority if you know what I mean, asks me what happened. I start to tell him, before I can even finish he tell me the law says that if he does not recieve the service for what he paid, it is larceny. I think I just stared at him dumbfounded. I was like what if I go to Target and by a TV and forget it in the parking lot and someone comes and takes it, will Target give me my money back?? He told me he wasn't there to discuss target he was there to inform me of the law and that I could be charged criminaly. Mind you we have done business in this town for ten years, donate to all town activities that we are asked to and have never had any negative dealings with the police. In fact all my interactions with them have been very professional, until now. He told me he wanted Credit Card reciepts and video. I told him I would get together info in next couple days. He asks me why I couldn't do it now. I told HIm because I couldn't. He said if he didn;t get it in next couple days, he would be back to have a conversation. MASSIVE TOOL. Then he has the balls to tell me that its only $30 and I should have just given it to him. The customer was thought I was rude and that why he went to police. Fuck off. I told him to do whatever he has to and walked away. I think he was a little surprised. He was a young kid and a reserve officer.

Anyway I am pissed at the whole situation. Now more pissed at the officer. For the record I have nothing but respect fo the police in this town and all the other I do business in. Just not him.

Understandable. Everyone has a boss of some kind. Did you call his boss (sergeant, Captain, whatever) and ask him, "What's up"? Maybe his boss thinks this guy is a 'tool' also.
