A 3 1/2-year legal battle over where an Odessa homeowner can park his pickup has come to a close.
On Friday, Hillsborough Circuit Judge Martha Cook awarded A.J. Vizzi and his wife, $187,443.37 for legal costs and fees spent to defend a case brought by The Eagles Homeowners Association.
"I was really glad to finally hear that it was all over," said A.J. Vizzi, standing in his front yard near the brown Ford F-350 that started it all.
Vizzi's homeowners association sued him for violating the covenants in his deed-restricted community. It said Vizzi had to park the large truck in his garage and not in his driveway. Vizzi countered that the truck would not fit, and he did not want a smaller truck because it would not be able to haul his 40-foot camper.
"I wasn't the aggressor in this. I wasn't the one who went after them," Vizzi said. "It was all just defense of something that I always knew that I was right about. And I just held my ground," he said.
A Hillsborough circuit court agreed and ruled in Vizzi's favor. In 2009, the homeowners association appealed. In March, the 2nd District Court of Appeal upheld the lower court's ruling.
Vizzi's attorney, Clearwater-based Dan Anderson, said the court found the provision in the covenants about trucks unenforceable.
"I never expected it would go this far. And, in fact, many times we tried to resolve the case," Anderson said. "I tried to end the battle and the association just wouldn't budge."
A call Tuesday to the lawyer representing the homeowners association was not returned. The association has 30 days from Friday's ruling to appeal the judge's decision.

You just made my entire week. I hope the losers that run these things stuff their head back inside their skull. They need to control their own lives and stop screwing with people because they think they can.

I've had the misfortune of having to deal with these types of slobs, and a good friend (who I warned) recently bought in an HOA -- now he gets monthly letters about every mundane thing -- things they enforce only on those they wish to enforce it on.

My apologies, in advance, to the one resident THT HOA President who I'm certain will find offense in my statement.

It's not just the HOA...my neighbor reports my boat in my yard every fall. The town's zoning officer comes down to measure my boat. If it's over 25' I can't keep it on my yard. He's been by so many times, now we are on first name base and he doesn't make an appointment, just comes by and makes sure it's the same boat.

Good Stuff. My dad lives right across the street from them. I just ignore my HOA now.

I would mail your neighbor and the zoning office a certified letter letting them know that issues about your boat are turning into harrassment and you are going to look into legal matters if it continues as you have had the same boat for years and the neighbor keeps calling about the same boat...

HA!!! Good to read although I expected to see this was about the Arbors Village where I pay my dues.... Same ordeal with a few neighbors with trucks and fighting it.

The best part is that one of the biggest complainers in the "hood" and ex chairperson got busted for driving over a Menorah at the front gate. She got busted on camera doing it so when the police knocked on her door she claimed it was an "accident".

"Maam, it may have been an accident the first time you hit it but the two times you backed up to run it over again is considered vandalism"

Bet the residents will pay closer attention the next time the HOA board votes to enjoin someone. I wonder if the HOA has the stones to include this guy in the assessment to pay off the judgment ...

Funny, we didnt buy a house on the water in '06 because my STOCK F-250 wouldnt fit in the garage. We were told straight up that there would be a $25 per night fine every night if we parked the truck in the driveway!!!

Jokes on them since the house is probably down about $300K in value now. Glade we stayed in San Marco!

Uh, unfortunately the worst part of the story is that everyone's HOA fees will probably go up to pay the $200 grand.

I agree with all the statements here, about HOA's. What fry's me about that case, is what it says at the bottom, that the HOA has 30 days to appeal the verdict. WTF? The already lost the initial hearing, and lost again, on appeal. How many times can they appeal?

I used to be the treasurer on mine, and now I'm just a director (decided to step down when I moved to a home with NO HOA)....and I say....Phuck them ALL... the only reason I got in the board was to stop the stupid letters. Thay got me soooooo pissed off that I decided to figth from the inside....

Someone I know had his neighbor call the city about an AC unit that he had at his house for a week to install in his other neighbors home. He got ticked so he went an got every toy or thing he could legaly have in his yard and parked it at the legal distance off the neighbors lot. I'm talking a 24' boat, 28-30' Trailer, glof cart, small trailer, lawn mower, tiller, and a few other things. Yea, the guy is kind of an ass but I laugh when I ride by and see all that stuff in the yard cover in gray tarps.

Is he immune to the massive increase in fees from the HOA? I once had an old lady drive down the street and stop in front of every property with a notepad writing down "violations".... I received letters about wrong flowers and crazy crap. What a POS.... I sat in front of her house with a video camera periodically after that... What happened to people minding their own frigging business? Our society as a whole has lost its' mind.
