Florida Certificate of Title Question
 
My dad passed away last month and my mom has moved out to California to be closer to family. We are in the process of selling his car in Crystal River Florida and I have question regarding handling the transfer of Title.

My mom currently is not on the cars Title. I have been told she can sign it as the surviving spouse and provide a copy of the death certificate.

Do you know if this is correct?

I believe so but contact the Citrus County Tax Collector to make sure you have everything the 1st time. Make sure it is a "certified copy" of the death certificate.

i think so,is it one of the newer ones that can be signed over a couple times?if so they need not be stamped.I would just sign his name and be done with it unless you need a notary and if this is the case you may need a power of attorney

You will probably also need a certified cop of the will as well, to prove she's now the actual owner of this particular asset. After all, it's possible he willed the car to someone else, or to a charity or organization. Just because you're married doesn't mean you get everything.

If the will has been filed with the probate court, your mom should have received a copy of the letter intestate. She takes the letter plus the death certificate to the tag office and they will transfer the title into her name. She is then free to do whatever she wants with the car.

The executor of an estate can sell anything in the estate. Let the Clerk of Court and/or DMV be your guide, it won't be their first ...
