Default Boat Bandit.com - Bad Business

On Feb 10 I ordered a VHF, I received a conformation and was told it would be shipped on the 11th. Late day on the 11th I received an email stating the product was no longer available. On the 12th while checking my CC online I noticed a charge for the VHF. I called and was told my CC would be credited that day or no later than Friday the 13th. Today is the 19th and I still have not received a credit. Monday, Tuesday, Wednesday I spoke with number of people who told me each day my CC would be credited. I just received another email stating they would credit my card today. I don't hold much faith in them. I emailed them back and said if my bank account does not have a credit from them by Friday I will file a complaint against them thru my bank. Am I asking too much? or is this just common practice?

They admitted charging my CC while they new the product was no longer available..... WTF is that about?

Call the service number on the back of your card ASAP. Tell thenm the order was cancelled and the merchant is yanking you around and you want the charge taken off.

If I understand the rules correctly, unless the item was something they had to special order or build, they are in violation of their merchant's agreement with the credit card company if they charged you without shipping it. It is probably time to file a complaint with the card company whether or not you get the refund.

Your correct, thats what my bank is telling me. They are sending paperwork which I should receive on Friday. I should have done this 2-3 days ago when I realized these ass wipes at http://www.boatbandit.com/ were jerking me around.

Not that it will mean much but I'm also filing a complaint with the BBB

It is a credit card purchase, you have 60-days AFTER you receive the cc statement showing the charge to file a DISPUTE of the charges. The bank is REQUIRED to presume your dispute is correct and IMMEDIATELY reverse the charges. The reversal is is PROVISIONAL. The bank then has 30-days from when it receives your dispute to contact the merchant and get their side of the story, and make a final decision. If the bank finds in your favor, the reversal of charges becomes permanent. If they find in the merchant's favor, the charges go back onto your cc statement, with interest.

That is the way it works, per federal law.

Having charges revered is not a good thing for the merchant. It affects the rates they pay for the ability to accept credit cards for purchases. After so many reversals, a merchant may lose the ability to accept credit cards at all.

So, the bank, not you, is on the hook for every disputed cc purchase. The bank, not you, is required to resolve the issue. You are only required to notify the bank, in writing.

I live near the store "The Bargain Bilge".Don't know why the online store has a different name. Walk in customers get the same treatment. Very small place. I gave them a list when I rigged my boat that came to $5K. 2 weeks of calls and no interest in selling me anything. I even went there twice to see if they wanted the business and the owner didn't seem to care. Call the cc company and file a dispute.

The good news is you used a CC and not some othe means to pay them. It might take a month to get it removed but it will get taken care of.

Non receipt of merchandise per the billing disputes process with your credit card is pretty straight forward. If the merchant can't provide proff of shipping and receipt by the customer the charge gets "charged back" to the merchant's account. Pretty much a slam dunk...Sorry you got jammed. No one needs the aggrivation.

That right there says so much. I don't even mess with retailers anymore. I have a Word file saved that is a template for disputing charges. Never had a dispute denied.

Something else to know; if you dispute delivery of a wrong item or something that is defective, the shipping cost are also refunded in the dispute, regardless of any seller's policy stating otherwise. Keep that in mind when you buy stuff from eBay.

You sure about that? I had an incident where I ordered a carb for an ATV. The wrong one came and the company eventually credited me for the carb but their policy was not to credit S&H. I think the "handleing" wordage is what gets around that. BUT, I wasn't taking that crap and I just created a website about how it was their screw-up and copied all of the emails back and forth and emailed itto the J.O. I had been dealing with and within a few hours I received an email back saying they would send a check out for the shipping. I told them I would remove the site when I received the check, and I kept my word. I also had to get my bank involved as it took them about 2 months to apply the original credit. Only about $ 35.00 total but f-them for being dicks.

Yup, sure, in fact, there are a couple pissed off sellers on eBay and one on Amazon that learned the hard way. And, nope, "handling" has nothing to do with it. The bank won't even mess around with trying to figure out where the money went. You dispute a charge, in total. It is either confirmed or denied by the bank, in total. I had one mail order retailer refund just the price of the item. I disputed the s&h portion and the bank reversed it.

you bought online to save a buck and it became a big hassel. welcome to internet shopping. and people wonder why brick and mortar stores charge more. its called service

they arent all like BOE, who you should be buying your products from online anyways, because he is one of the few vendors that cares about his reputation.
