PORTSMOUTH, N.H.—A Portsmouth, N.H., man has been jailed on a felony charge of violating a protective order after he allegedly showed his middle finger to the person who filed it. The two were dining separately at a restaurant on Jan. 24 when police said a 42-year-old man made the gesture.

A police affidavit said the man eventually left "with some assistance from restaurant staff."

Police Sgt. Kuffer Kaltenborn said violation of protective order charges can be brought as felonies when the allegations are second offenses. However, he said, the city prosecution office is expected to dismiss the felony against the man on Monday, leaving a misdemeanor count of stalking.

The man was being held at the Rockingham County House of Corrections on $7,500 cash and $7,500 personal recognizance bail.

I think there is more to this story than what was reported here. When you see "second offenses" and "violating a protective order" it makes you wonder.

What happened to "live free or die"?
Someone exercised their right to "Live Free" from this guy's harassment and got that court order.

In NH we have several options for dealing with threatening behavior. We can walk away. We can bear arms to defend ourselves (written into the State Constitution). Or we can seek legal protection through the courts and police. Having these options allows us to respond with proper priority to miscreants.

Next time he should use the words and the finger, if you're going to jail you might as well make it worth it. Might as well call the guys old lady "Hoo Waa" while you're at it.

This exact same thing came up in England a few years ago. Some guy flipped of the royal motorcade as it went past. He was arrested, went to court and claimed he was exercising his right to express himself. The court said the guy was an immature asshole, but agreed it was a protected freedom of expression that endangers no one.

NH is very strict about protective orders. They are usually "No contact" and the judge expects that to be complied without any wiggle room (actual practice depends on the judge and the complainants lawyer).

We had a case a couple years ago where a man (I think it was a stalking case) had his lawyer pass the complainant's lawyer a letter to be forwarded to that woman. The 2nd lawyer decided that passing the note could put him in contempt and reported it to the judge for disposition.

The judge issued a bench warrant and the author got 30 days at Chez County.

Flipping the finger is definitely "communication" and the creep refused to leave the premises when requested by the management. That says even more about his personality or at least his intelligence.
