Although the actual incident happened a while back, the sentencing phase Tuesday is a PERFECT example of the Federal government's TOTAL inability to enforce the laws on illegal immigration - and the judge certainly said as much!

Illegal guy, NO driver's license, TWO times over the legal alcohol limit, driving 55MPH in a SUBDIVISION, in the COMPANY truck, FLEES from the accident ...

Even though he'll get out in 10 years - he'll be IMMEDIATELY deported. LOTS of luck on the family getting a PENNY out of him in CIVIL court - before or AFTER!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

BUT, BOTH families are filing CIVIL suits against the COMPANY he worked for!!!!!!!!!!!!! Probably a good idea, since it appears they (company) could have/SHOULD have known his legal status, AND, the fact he had NO license, while driving THEIR truck!!!!!!!!!!!!!!!!!!!!!

definitely sad. However, "stopping illegal immigration" through immigration policy is not going to stop it at all. We first have to FORCE natural Americans to go to work rather than sit at home and collect, and put an all together end to the system that allows them to do so. When, and and not until, this happens, a high illegal population, and all of the negatives that come along with it are here to stay.

Until we address the reasons for the demand behind the illegal immigrant problem, the flood will continue. The genie is out of the bottle, Pandora's box has been opened, etc, ect......

A civil suit isn't delayed just because the "defendant" or a witness is in prison, especially if it's the same state. However the principle of "deepest pockets" will apply here.

I believe vehicle owners, especially businesses, are considerred to have the primary liability for dameg caused by their cars and trucks.

The employer should have verified the employee had a valid license to let him use their vehicle but if they are the sort of people who don't care about immigration status then it's not surprising they are lax in other responsibilities too. After their fines I hope they have enough money or insurance to pay the claim.
