Default Why we need tort reform

A kid almost drowns and one of the cop's that responded slips and falls and has filed a lawsuit against the victims family, incredible.

Wouldn't dare blame the LEO would you? She knows how the system works. She knows how to say no. She knows how to say "just doing my job, ma'am."

I would have figured you for a personal responsibility kind of guy.

We need to bring our civil litigation in line with the rest of the civilized world where this kind of thing doesn't happen because the plaintiff has some money at risk with the filing.

This is the most disgusting thing I've heard of in a long time. This is all on the cop folks. An attorney can help a client in this situation, but the client has to pursue the claim.

Okay, let me see if I understand our legal system. I'm out in my boat and a big storm comes up. One thing leads to another, and I send out a distress call to the Coast Guard. They arrive to assist me, but an officer slips and falls on my boat which is being tossed around like a cork. He breaks his kneecap, and it's my fault because I should have known better than to have my boat out during that storm. Had I been a more prudent captain, the Coast Guard officer would'nt have had to come rescue me.

Can you imagine what this family has gone through only to have this lame brained officer try to captialize on their tragedy? I wonder how that officer's co-workers now feel about working alongside this person?

While I personally think its wrong what the LEO doing and I would not. Personal injury attorney's are the ones driving this sue happy society. I also have never sued anyone.

I expected you wouldn't approve of the officer's actions. Good for you!

No doubt the personal injury attornies dangle carrots in the faces of accident victims, but no attorney can force anyone to sue somebody. It all boils down to basic greed, on both sides of that particular fence.

I agree with you Cracker that lawyers are a cancer in society, but I doubt that this cops lawyer held a gun to her head and forced her to file the lawsuit.

Okay, now that I've let off some steam, I would bet this is how this thing has played out.

Cop falls, gets hurt. Friends, family, co-workers say sue them, their homeowner's insurance will pay and it won't hurt the family at all. Cop perks up and says, "why not? I got hurt on their property and I hate insurance companies. Look how much I spend on insurance myself."

Somebody then suggests the insurance company won't pay off (at least not as much) unless you hire an attorney to show you mean business. Attorney paints much bigger picture with more pockets to dive into. "You are disabled for life, you deserve this money, forget the fact I'm taking 30% off the top."

Before you know it, the pool installer, the water supplier, and the floor manufacturer who made the floor the cop fell on... they all become part of the lawsuit.

Do you blame mortgage brokers, or realtors, for our current mortgage debacle? I don't. I blame the dolts who took out a mortgage they couldn't afford to live in a bigger house to impress their friends and neighbors.

How about credit card companies? Do you blame them when some schmuck runs up $50K in debt and files bankruptcy? Those debts in bankruptcy don't just disappear, they get passed on to me and you.

Some folks need to blame someone else.

My oponion, sorry if you dont agree.....I put the blame where it belongs. The guy that stands to make 40 to 50 percent on these silly suits.... Some of the cases are justified, but many are people gold digging with attorneys inviting, encouraging and pushing these cases.
