If you heard of this already, then I apologize for posting this again. But we must all act on this. Even the EPA does not agree with the 9th District Court ruling.

To amend the Federal Water Pollution Control Act relating to recreational vessels.


IN THE HOUSE OF REPRESENTATIVES


May 24, 2007

Mr. TAYLOR (for himself and Mrs. MILLER of Michigan) introduced the following bill; which was referred to the Committee on Transportation and Infrastructure

A BILL
To amend the Federal Water Pollution Control Act relating to recreational vessels.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,


SECTION 1. SHORT TITLE.

This Act may be cited as the `Recreational Boating Act of 2007'.


SEC. 2. DEFINITIONS.

(a) Pollutant- Section 502(6) of the Federal Water Pollution Control Act (33 U.S.C. 1362(6)) is amended--

(1) by striking `or (B)' and inserting `(B)'; and

(2) by inserting before the period at the end the following: `; or (C) any deck runoff from a recreational vessel, any engine cooling water, gray water, bilge water effluent from properly functioning recreational marine engines, laundry, shower, and galley sink wastes from a recreational vessel, or any other discharge incidental to the normal operation of a recreational vessel; except that this subparagraph does not apply to rubbish, trash, garbage, or other such materials discharged overboard by a recreational vessel'.

(b) Recreational Vessel- Such section is further amended by adding at the end the following:

`(25) `recreational vessel' means a vessel--

`(A) manufactured for operation, or operated, primarily for recreational purposes; or

`(B) leased, rented, or chartered to an individual for recreational purposes.'.

You can't dump "poop" within two miles of our shores and not on inland rivers and lakes.

This has nothing to do with dumping poop. What it has to do with is the gray water issues of ocean going commercial ships. They will use water from their point of origin as ballast. The problem is they enter our waters and now release the ballast and it can contain livestock and organisms which are not native to our area and can do harm to the environment. An example is the zebra mussle in the rivers and great lakes. There are many others.

What happened is there was an exemption on gray water - which incidently can be water that washes over your deck - for recreational boats since they don't usually travel internationally like commercial ships do so there is virtually no chance of the release of foreign livestocks and organisms. The court struck down this exemption and that means that the owners of recreational boats must apply for a permit which will cost $800. There is a bill to ammend the act and re-establish the recreational boat exemption.

I saw a show on this subject about a year or so ago. Pretty scary how many non native species living and taking over native species in many different port across the country. I remember a port in California, of 20 some odd species of aquatic plant life found in the area only a small hand full were native most of them were over run by foreign species.

Kinda reminds me of our borders

Something definitely needs to be done to change current actions.

Menzies, you still haven't explained what or why there won't be a need. There is a need to correct the bill so it applies to commercial vessels ONLY and not include recreational vessels as the 9th District Court ruled. That can only be done with the bill by - you guessed it - your federal law makers. Maybe it's not important to you, but it IS important to others.

So Menzies, what is your problem? Enlighten us. Educate us. Or STFU.

Ah, the old STFU defense when one doesn't really understand the argument.

The bill is not yet in question since the court has not yet ruled. Let the court rule (with a good chance that it will uphold the exemption and put aside the lower court ruling). And then grasshopper, all will be well in your world - of course the Boat US, Boat Test, and other corporate entities will then need another contentious event to drag you to their web sites and subscription!

Another great example of the bozos in DC in action. If they think they are going to "protect" anything with a law that can be circumvented with an 800 dollar permit, they should be locked up in a rubber room.

Wow Menzies....it took telling you to STFU to get you to part with some info that we weren't aware of. So in essence your saying that the NMMA, Boattest, BoatUS, et al are lying when they say the 9th Circuit court made a ruling already. Or are you saying there is an appeal? If it's an appeal, then who is appealing the ruling? You telling me not to worry makes me worry even more. You are one vague person.

No where in that thread do you give a link to support what you say. So we're to take your word on what is going on? Someone who likes to leak a little bit of his argument at a time like a long grand entrance. If the EPA doesn't write out the recreational boaters then we stand to lose. So our legislatures can do it for them. It's what I pay them for. So I don't have any problem with "distracting" them from writing more useless legislation or robbing us further.

As CaptDAn said:

"menzies, if our fine, upstanding legislators see get a whiff of an untapped revenue source through a tax they could pass on an unsuspecting, fairly unrepresented group, they'll do it in a heartbeat."

I don't think this will ever go through but you don't ever know. I do think that there is propoganda though to rally the citizens. The permit could easily cost $20 bucks and be good for 10 years. Who pulled $800 out of the their azz? I sent the email anyway.
