Default Traffic citation / summons

Guys,
My employer lets me use a mini-van for business. I also use the van quite a bit for personal use.(tax free) Management knows this.

The regional VP just came to me with a traffic citation / summons for my van.

The violation was dated 2-28-07. The problem is, I wasn’t in the area(100 miles away) on that date for the violation to occur.

I wonder if I should just pay the $57.00 so no one questions all the personal miles?

Or should I tell them, I wasn’t at / near that address for the violation to occur.

I really don’t have the time to go to court to try to fight it.

I’m ready to pay the $57.00 and move on.

Thoughts?

Parking prohibited...........Street Cleaning.

The area is a suburb of Philly !

Many locales will let you contest parking tickets in writing without you having to appear. Read the ticket or call and see if this is an option for you.

Also, check the ticket and see if the license plate no. and vehicle description match yours. Usually, this case of mistaken identity occurs when the license plate no. is recorded incorrectly. If that is the case, the vehicle description will almost certainly bear no resemblance to yours. You can use that in your defense.

If you have to appear to contest the ticket, if it was me, I'd just pay it. Mail them $57 or spend half a day with a court appearance? Neither is an attractive option, but it's still a no-brainer.

I would pay the summons, and leave a note on the VP's desk telling him that you paid the summons, as the last thing you want is for small issues like that to detract from his time. But... also telling him you were never in that area and the summons is bogus. I would add as a final sentence that should you ever get a summons on their company vehicle, you would have paid it on your own so that it didnt come back through corporate channels.

Don't pay it. Parking summons are in the name of the registered owner. If the van is lent around the office to multiple drivers, then the one responsible should pay. If you weren't there and the boss knows it, then he/she is out of line to make you pay the ticket. If you pay, you will pay again, and again...

I'm the only driver !

I just spoke with the Assistant to the Magistrate. She said write a letter and they will likely dismiss.

Now.........who do I know that might know a Philly COP ?

A Ha ! The previous driver is a Philly person and likely has connections. Gosh......I thought they were a team player !

something similar just happend to me. I emailed the town parking/traffic guy,nicely explained I had never been to the location in question.he asked for the violation number and got back to me the same day. "it was a mistake on their part and they were very sorry"I almost couldn't believe it. actual competency in government! definately worth a shot in your case.

True............but, the morel value is much greater!

I have to say there has to be some sort of record on who used the vehicle that day! Get them to pay up......why should it be "your" responsibility to pay for "someone else's" screw up?

I get alot of parking tickets near my office.

Sometimes they punch in my license plate number incorrectly. They use a K where I have an X. I do not pay those tickets and never receive a notice about them. But, the person whose license plate number was placed on the ticket must get a notice and have to do what you are going to do.

And before I get bashed for causing someone else a problem, I am not the one that incorrectly prepared the ticket. Not my problem IMO.

Years ago I received a summons for Philly as well! I called and requested a copy of the ticket. Turns out the vehicle listed was a green Suzuki Sidekick ( I think), while I had a Dodge Intrepid. I ended up writing a letter and enclosed a copy of my registration for the time of the ticket and it was tossed out. Officers do make mistakes writing the plate number. I think in my case they wrote a O instead of a C.
