Default DC judge loses lawsuit against cleaners

This is just stupid beyond compare!

--------

WASHINGTON (Reuters) - A District of Columbia judge on Monday lost his $54 million lawsuit against a dry-cleaning shop that misplaced his pants.

Roy L. Pearson, an administrative law judge in the U.S. capital, claimed that Custom Cleaners violated a consumer protection law because it posted a "satisfaction guaranteed" sign but did not pay him more than $1,000 after his pants got lost.

But the judge hearing the case, Judith Bartnoff, ruled that Pearson had failed to show that the Korean immigrant family named as defendants had violated that law.

The two-day trial drew international media coverage and widespread ridicule as an example of over-litigiousness in the United States.

Pearson was not immediately available for comment.

--------

This story it is ironic because I was just reading about how the corporate media is bracing itself in preparation for libel lawsuits from judges it criticizes. Last year judges filed about 1000 lawsuits, about 1/2 of them in federal courts. But you CANNOT sue a judge. That was the crux of what I was reading; how judicial immunity is out of control. A judge can sue you but within the same context you cannot sue a judge.

I saw the details on this a while back, and I have two questions.

How the hell did this ever get to trial?

How could the trial have taken two days?

There had been talk of sanctions against that judge/attorney who filed that suit by the powers that be who look after things like that. Anybody hear the outcome of that one?

Oh yeah, that guy had been appointed as judge, not elected. Too bad.

His actions echo that of the Carolina DA. He should also be disbarred. If that case is not BS, there aint one

Washington, DC)— Following the verdict in favor of the Chung family, American Association for Justice (AAJ) CEO Jon Haber issued this statement:

“A multi-million dollar lawsuit over a pair of pants was both ridiculous and offensive to our values. Our civil justice system must be reserved for those who seek fair compensation when they are the victim of true wrongdoing or negligence. The court has ruled wisely in this matter. Opponents of our civil justice system should pay heed to this decision – it clearly shows that the system works to deny outrageous and ridiculous claims.”

AAJ has been sharply critical of Judge Pearson’s lawsuit seeking $54 million in damages over a lost pair of pants. In April, AAJ CEO Jon Haber called on the District of Columbia Bar Association to conduct a disciplinary investigation of Judge Pearson for his conduct in this matter. Haber and AAJ President Lewis “Mike” Eidson pledged to support the defendant’s defense fund and encouraged the AAJ membership to also contribute (www.customcleanersdefensefund.com).

Hey, this kind of crap would go away real fast if the person who files an unsuccesful suit has to pay the legal expenses incurred by the person they took to court. Otherwise, you could literally put your competition out of business if you wanted to keep them wrapped up in frivilous lawsuits like this one.

It makes me wonder if you could represent yourself in a case like this not being an attorney and just keep filing suits until one pays off. Did anyone catch the pre-trial settlement amount which was offered to that idiot judge who filed this suit? I don't know if the info is still on this site, but it was five figures and he rejected it!

I've read they offered up to $12,000.

See below for the Judge's photo

"Judge Pearson was also ordered to pay back court costs."

And ...

"Meanwhile, the Chungs are asking the court to force Pearson to pay the thousands of dollars in legal fees they've spent defending themselves."

Oh, it gets better. The judge that heard the case and decided in favor of the cleaners filed a 22-page decision. Yes, that's right...22-pages to say "dude, you're a nut case, you lose, now go away."

So where did Roy Pearson go wrong? Was asking 54 mil. to much? Would he have won his case if he only filed for 2,3,4,5 mil? Probably!
