Rental woes!!!

Default Rental woes!!!

Looking for advice. Anyways, my family and I moved to North Carolina back in december 06' singed a two month lease with a girl on her house and month to month after that. Her mother tried to get me to sign up longer 6 month lease but I said no. Two was good for me because we didn't really now what we were doing. Any way making a long story short, about one month ago we recieved a notice of foreclosure served from the police. Being a little worried about having to move my wife, two kids and two dogs. I went ahead and called Holly (girl who owns property.) and asked her If she knew what was going on. She kindly said she had no Idea and assured me that there wasn't anything to worry about and that her boyfriend was going to be selling his condo and buying the mortage out. O.k. this sounded a little fishy so I called the lawyer who sent the foreclosure notice and asked them what I should do. They kindly replied and said whatever you do do not give her any more money until she sends a letter from us saying this is all straightened out, and plan on being out by june 23rd. 2007. This is the day of the auction. Cool two months rent free and we'll use it for buying and moving too our own house. Well that was going as planned until her parents got involved and are taking over the mortgage. They called two days ago and asked for a check to be deposited in an account, I didn't call back, as I needed some time to think. Well tonight (Saturday.) The mother called back and said If you don't call us back by sunday and pay we are calling our attorney. In the mean time for stability reason and finacial reasons I decided to buy a house. We will be closing on the 30th of may, and plan on moving out that day or the first of june.
Should I pay these people the money or not. We have went through alot of grief and rushed to buy a house. What legal rights do I have. If anyone has any input on this I would greatly appreciate your posts either way, I also do not want to get into any trouble, If I can help it. Thanks Ron Sergeant.

If you lived in the house you owe them the money. Why would you think that you should live there rent free just because they were having financial problems.

You signed a lease - they can easily sue you for what you owe and other remedies spelled out in the lease, plus attack your credit.

Seems cheezy to me to try to take advantage of someone else's misfortune

Thanks for the replys. The reason that I am upset and I guess I didn't mention this was I have paid all my rent always a couple days early. And when I asked Holly what was going on she basically lied to me. And like the Foreclosure lowyer said. "I wouldn't give her any more of your money, she isn't paying her morgage. and is having fun on your thousand a month." I just feel that basically I got F@#&ed because the landlord, Holly said that if we wanted we could stay here up to a total of three years, and she knew she was getting foreclosed on. And I had to rush out and figure something else out. Because I am responsible and want to make sure my children Lexus and Ronnie and Wife Meghan, all have a roof over their head. Shame on me for not wanting to pay the Bitch! Glad I have always paid my bills... One hell of an interest rate on the new place. 6.2%

One more thing. IF the girl doesn't have enough with my money to make her payment. Then how am I going to get my Deposit back. And The house Is in Better condition than when the Landlord left town.

If you rent ..... you pay, that really is the bottom line.

The advise you received earlier from the foreclosing attorney was good advise and you should heed it, but I would still put that rent money in escrow for the time being. What “proof” do you have that the parents of the girl are indeed picking up the mortgage? Personally I would want "legal proof" and the foreclosing attorney would tell you that as well, but I would still be putting that rent money into escrow.

Now I don’t know about in your neck of the woods, but any place that I’ve known of ALL the laws are in favor of you the tenant and not in favor of the landlord. Even if the tenant does not pay their rent on time or at all the landlord is on slippery ground in that they can not badger the tenant for that rent......that’s called harassment (and that the tenant will win everyday in court!).

* I’ve had joint custody of a rental property with my brother, my brother’s had three and my father-in-law has had a four-plex for well over 40 yrs.

PAY YOUR RENT......!!!!....deduct your deposit maybe on the last months rent....but have your landlord see the residence
before you make final payment..

What does the house being foreclosed on have to do with owing rent? You signed a contract to rent the house.

ClarkLLC has given you the best advice....let your last "payment" be the deposit they are already holding and move into your new house.

Since the parents bought the mortgage out, do you then owe them the rent that their daughter was supposed to collect? I would look into this, as I am not sure back rent can be transfered to a new owner.

Wow, I wish I could have explained this whole matter, more in detail. And I should have. I'll put it this way, I have looked for advice and respect from people on this forum. And when I can. I try to help out with any knowledge that can be of use. I relieze that I asked for opinions either way. Hey New F Have you ever been In the position of being evicited out of the house that you have paid a thousand dollars a month, to a person who basically skipped town and is having a hay-day on your money. I have gladdly given this girl her rent early each month, And Holly( my landlord.) will even tell you this, before it was even due. Next time you ever discredit someones integrity or cut them down on a public forum make sure you know all the facts. I relize that I don't know you personally, but you seem very judgemental. All I asked for was opinions of what is Right or Wrong! Not If I was some non Paying 500 credit score loser. Take a look at the other posts. Yes they state what they want to say but they don't cut me down. Please out of respect for me and others don't do that again. Thanks everyone for your posts I will make my decision from here.

One other thing Mr. or Mrs. New F (sorry I am getting a little fired up here.) could you please tell me who I should pay the money to. You seem to know everything else. The non-paying daughter, who is probably not going to give the money to the mortgage company, The parents who god only knows if they are telling me the truth, in the fact that I have asked them for papers (for proof) and have still not seen these yet or the ones who are really getting screwed the poor little mortgage company. These forums are for constructive critisism. Not down right bashing of a person. Man I am pissed off right now. sorry every body else.

Ron call the lawyer back and see if he can tell you WHO the legal owner is and go from there as to who gets paid.

No question you owe the rent. The real question is who do you pay? Pay with a check (not a rubber one) AND get a receipt for it noting all of the info and hold onto that paperwork for a long time. Stash it all with your new closing documents.

Cover your butt. We just took it in the a$$ for over 6K plus legal from a scum bag, who wasn't when we started. We were trying to help him out.
