Default any lawyers out there?

that are bored?

Alltel screwed me out of $200 and I really just don't have the energy to deal with it. If you want the $200 or maybe have an intern - might be good practice.

They tell me that I agreed to a new two year plan when I got my new phone a year ago. I ported over to Nextel and they hit me. But they don't have anything recorded or signed by me. They shut off the wife and kids phone, effectively extorting the money not i'm really ticked off.

Good luck finding a lawyer for $200.
Every cell phone plan has an early termination agreement. I'm betting somewhere along the line, you signed something that has that in the fine print.

I expect if you find your very first contract there will be something in it about verbal renewals that binds you to the new terms. You could sue in small claims but I think the odds are aganst you.

Two year plan eh?

Look at something called "The Statute of Frauds" and argue it yourself.

Beware the arbitrartion agreement in the contract....

Lots of "worm turns" things in here...... and no, it won't be easy fighting it.....

Ok sounds like too much trouble - since I travel I will never he around to take it to small claims.


let it be known that ALLTEL SUCKS!!!!


Problem is, I had good coverage with them, but EVERY time I called for customer service I felt like I was raped. When you've spent $300 plus every month for 3 years with a company, you would expect to get some sort of real customer "service".

I guess not.

Just one more reason why I would never sign a contract with a phone service company. Only pre-paid for me.

Aren’t they all the same?????? How do you spell shysters?

Contracts put the screwor on top of the screwee, bad positioning Id say.

I have learned a lot in 73 years of occasionally being the screwee. I’m getting good at avoiding the bottom position.

Sounds scary to me. Guess that's why I still climb the telephone pole and ask Sara to patch me thru to whoever I want to talk to.

Never get mobile service with more than a one year agreement.

Can't get a one year? Don't use that company.

Simple.

I've been using T-Mobile for a number of years, and still am happy with them. However, if I ever become UNhappy, I can drop my plan to the lowest possible and wait for my contract to expire, then leave. I went back on contract about 9 months ago to get a promotional plan and phone I wanted - first time "on contract" for me in close to four years.

Do it this way, your risk of being "on the bottom" goes way down.

That's the thing - I could have done that and just paid 4 more monthly bills at $10 for the phone!

About the only chance you'll get a lawyer to look at it (short of paying an hourly fee, which would not be economical) would be if there was a possible class action involved, i.e., Alltel did something illegal and they did it to a lot of people.

Short of that, it couldn't hurt to send a letter to your state Attorney General and possibly the FCC. And it you haven't already, try to take it up the chain at Alltel. Find out who the chairman is and send him a letter directly. It's a long shot, but every now and then people get satisfaction that way.

I just wish I could convince my wife to switch. One word from her and about a couple thousand people would dump them too. Not many in the grand scheme, but enough to make me happy. I'm pretty easy.

'Round here Verizon was the only provider that covered my house out in the boonies and no worries over the 2 year contract. But DAM#! I think I would do as Adam suggested and take to bitchin up the food chain as it were. A couple of pluses along the way: you get to bitchum out and vent and "the squeaky wheel gets the grease." You might get some help up the line. Too bad your wife doesnt get the bigger pic and drop the word....

What about filing in small claims court? The filing fee is like $20 and the forms are simple. I do not know if you will win or not but they will have to show up and dispute the claim and that will cost them some money. I have not done it yet but have seriously considered it.
