Default Caught a dude with weed on my boat!

Took several guys fishing this past Saturday. One was a “friend of a friend”.....I didn’t know him, but my friend that brought him is a great guy. He said he was his “old college roommate” and showed up to visit. We fished Matagorda bay Tx. on Saturday, not catching much.....he birdsnested one of my buddies baitcast reels.....which was done for the day. Since we weren’t catching much, we beached the boat alongside some other boats and pitched some washers on the beach with some other friends and had a couple cold ones....just having a good time enjoying the weather. I was in the boat and noticed him digging through his bag and he pulled out a small baggy of Marijuana. I asked him “is that what I think it is?!”......to which he replied with a deer in the headlights look...”oh yeah....sorry forgot to ask if it was ok”. I told him to go somewhere and roll a big one, because “you aren’t getting back on the boat with it”.

I don’t have a problem with smoking grass.....hell, it probably should be legalized in small amounts and I tried it in college, but didn’t care for it. But damn, it’s till illegal in Texas and pretty thoughtless and could have put us all in a bind with TX Game Warden had we been checked. My buddy who brought him was also pissed and apologized profusely. I’m wondering if a game warden could have given all of us a ride. Anyone familiar with this?

I think that is a little harsh. That would not be a big deal to me, I have been boarded by coast guard and TPWD many times and they have never had a dog with them.

So it’s OK to get drunk and drive your boat back from the beach, but not a little weed buzz.

I really don't have a problem with the use but he should have asked before bringing an illegal drug on your boat.

Am I understanding that the person who is drinking and operating a boat is complaining about someone having a little weed?

Get caught outside state waters with weed and it is a federal offense from what I understand. It's not legal at the federal level.

First offense for possession is up to 1 year in Federal prison and up to 1,000.00 in fines. That's everyone on the boat. Boat likely gets confiscated.

It's not illegal to drink and operate a boat (at least in Maryland, as long as you stay under .08). I would have reacted the same way, guy should have asked before bringing it onboard.

I used to hate it when people would bring certain items on my boat without mentioning it to me.

I'd guess game warden wouldn't care unless you were in some other violation and being a dick, then he might tack that charge on. I agree that it is uncool of him not to ask or say something but these days it's nothing more than a jay walking ticket in most places. Not sure about Texas but it has also been decriminalized in a lot of areas too. Personally I think you're over reacting, did you really make him throw it out?

LE including CG used to make a huge big deal of it, like ten years ago.

Lately I have not heard of any enforcement. I don't smoke it, but lots of friends and acquaintances do. They seem to say keep it discrete, out of sight, very small quantity and don't get stoned. CG when boarding my boat did not seem to be looking it. But since it was not there, they could not smell it.

I would not make a big deal out of it, but I am not in TX.

Aint it still a felony in Texas .....saw this on the now cancelled greatest show ever Live PD, I was shocked its a felony You were rather nice about it I'll say

Maybe with the use of "weed" so widespread, and you were taking a group onboard, including at least one you did not know, you should have made everyone aware nothing illegal was acceptable onboard, especially due to being subject to a Texas Game Warden search without notice and you possibly being a licensed charter captain? I have a friend who brings it onboard while we are in route to his bay cabin near Baffin Bay, but he only uses it before hitting the rack. I don't imagine a Texas Game Warden would hassle your entire group if one person is found to be carry weed in his gear, but it would not hurt for you to call a game warden and ask his advice and learn what their practice in such a case.

He should have said something beforehand ... drugs or guns or medical conditions or anything else that has a law attached to it or I maybe responsible for . No surprises . Looking for a nice smooth day to be had by all .

if possession of "marilla" inTX is illegal than you have a right to be pissed
overall, is not the same as with alcohol, as long as you are sober everybody else can be fu up
once they legalize the possession and you don't BUI than who cares

technically he wasn't on your boat when you caught him. I would have been pissed. Pissed that he didn't offer some earlier in the day.

It's just weed dude, it may not be legal in TX (yet) but it's better for you than a "cold one"

Assuming simple possession and CG here. Only the person in possession of it can be charged. The boat won't be confiscated. Depending upon how far offshore it may be a misdemeanor or it may be a civil penalty.
