Default US Department of Labor Hires the Handicapped.

The mentally handicapped, that is.

A couple of years ago we were "chosen" by the DOL to report salaries, # of employees (supervisory vs. non-supervisory), hours worked, pay periods, commissions or not, etc. It's supposed to be reported and include the pay period that includes the 12th of the month. How they picked the 12th is beyond me. Keep in mind that this is a business with 12 employees. I mean, we ain't talking about a statistically changing size business here.

I have sent the reports even though I dont think it's any of their damed business. I also asked if I could just quit and was told that NC is a "mandatory" state, whatever that means. This past October I apparently let it sit on my desk a little too long according to them. They faxed a copy of the last report to our office where anybody could see it. I sent a blistering letter asking them not to send it to an open fax again. Well, guess what. The brain children did it again today. I called immediately, explained what they had done, and reminded them of my previous letter. All I got was this canned chit and a "friendly" reminder that I was late with the November report.

Here they are faxing sensitive data to an open fax machine and when I try to get it thru their thick head, I picture glazed eyes on the other end of the line. There ain't nobody home. Thanks for letting me rant.

Now the question. If I just tell them to stick it and refuse to send any more info, how bad could it get? Do I get a bunch of "friendly" reminders, do they leave me alone, or do I go to jail?

29, I was faxing the reports to them. They must have picked up the # from my outgoing faxes. I stood there every time to make sure nobody saw the reports. Never thought for a minute they would send a copy of the previous report without at least calling first. I think I am going to just draft a letter and tell em to stick it up their azz. Will ya'll come visit me on Sunday afternoons?

Do all businesses have to abide by this BS? I don't see how they can make you do this legally. Don't they have all this info via tax records, and such? See if you can get away with a little disclaimer that states if they refuse to fax to another line than you will no longer be wasting your time by divulging the information they request.

Maybe somebody with a law background will chime in, but that doesn't seem right. That's some pretty sensitive info. to be sending around. Next time they contact you, call them and ask to speak to a 'supervisor', or somebody higher up the chain and see if you get a better response. Can't hurt to try.

Shag, demand that they send you the article of the Federal Register that gives them the right, and you the obligation to provide this info..... That puts the burden back on them and they'll go seek easier prey......... usually.......

Does their fax to you include the name of the person sending it? If it does that person may be guilty of breaking the confidenciality laws. You'd have t file a complaint with your Attorney General's office. You could also advise your employees and they could decide if they wanted to file suit or complain to their legislators.

Probably not worth the effort though. Best advice is to make this paperwork a higher priority item than in the past. If your work force is stable, prepare a report that only leaves the variables blank. Fill that in by hand and fax it by the deadline.

Without knowing Iím gonna make a wild-assed guess, and that is all it is, just a guessÖ I am going to guess that you are not required to submit any of that info to the feds UNLESS you have contracts with a dept of the federal govít. Iím gonna guess that without federal contracts or federal oversight of your business (i.e. required a federal license) your business is entirely within the dominion of the state you are in and the feds canít do or say anything about it.

Only 12 employees? Call a company meeting and ask everyone if they mind having their employee data made a part of the fedís public record. If they say no, send a registered letter to the DOL telling them your employees decline participation in the program and you will not be sending anymore confidential data to them. However, if they want to come to your place of business to interview any employees please call to schedule an appt and you will arrange a meeting between the DOL and whatever employees want to meet with them.

I could see a one time deal, but an ongoing data report requires material and administration expenses......why would only your company (per say) be burdened with this extra administrative expense and your neighboring business not be? That doesnít seem right to me!
