Default eBay purchase not what was listed? seeking advise

I recently purchased a "new" set of wheels on eBay.

The below photos are what I received.

The seller acknowledged my concerns and has been responsive but they want to run the damage thru a Fedex claim.

I have 2 issues with that:

1: The wheels are not what was advertised (new) (seller acknowledged that after I sent them the same photos below)
2: There was zero protection to the wheels they were shipped from Oregon to Rhode Island bare in the box, to add to that, the seller acknowledged the boxes had been used a few times previously

With that said, I want to avoid any pitfalls with eBay and could use any suggestions on how to best protect myself and what you all think is a reasonable resolution/solution.

I have zero issues returning them, it will be a hassle and that is fine, but I am more concerned I will be required to cover the shipping costs. I take issue with that as I was sent something I did not order (new wheels). I do not think that is reasonable as shipping will be north of $200.


At this time nothing has been asked of me other than pictures and to make myself and pictures available for FedEx .

those were messed up before they were shipped. the clear coat pealing is a repair i think.

I hope you paid with a credit card. Using them, even through PayPal gives you a last resort defense, and they almost always side with you (the buyer) when it comes to online purchases.
eBay and PayPal not so much!

You should post a link to the eBay ad/auction so we all can see the discrepancies......We need the whole truth!

I assume you paid via PayPal? I would advise the seller that you ordered new wheels and the damage does not appear to be shipping damage. You want a full refund and they pay shipping to return the wheels. At some point in the near future, you will have to file a claim with Ebay and PayPal. The few times I have had issues with a seller, Ebay and PayPal were very responsive and ruled in my favor.

Ask the seller for a return label and full refund. If he cannot provide that, get eBay involved. They should favor with you.

Give the seller 1 chance to make it right. The return is on their dime and not yours. I would guess that they were damaged and they want FedEx to pay for new rims.

You are probably right but in any event, it's the sellers problem. I agree, have the seller send a return label, refund your money in full and they can take up the fight with FedEx, it's not your fight nor your concern.

Whats sad is when Craigslist crap starts showing up on Ebay...

Selling anything on Ebay costs you 13%....so lets hope they step up.

The few times I have had to get them involved it has worked out for me.

Ebay will give you a refund for the item not being as advertised. Start the process from your myebay page.

just contact ebay. If they can't help they will direct you to paypal. Then contact your CC. Make them pay for return shipping.

If the item is not as described, Ebay has money back guarantee. Click return item, then select item not as described, and Ebay should give you a return shipping label for free. I just went through this process recently.

And in the Listing Seller did not list as "New"......He listed them as "Brand New" !!!

I bought a small truck lip/spoiler for one of my cars and when it came this week it did not fit- was too wide.
Went back and forth 6 times with seller. He was grilling me on model and year and then still didn't believe me and asked for pics.

OP,
The only thing that actually got the return label processed and sent to me was trashing his feedback. Then he got mad at me and demanded I retract feedback before he would refund.... we will see. online shopping always an adventure...

I used to sell a lot on eBay/Amazon- I can tell you I have never once won a customer dispute even when it was clear and obvious fraud. Most of the time the package "never arrived"and a tracking number only proves it made it to the same zip code. It happens, but it seems to happen to others 10x more than it happens to me. For expensive items, a lot of time someone coincidentally in the same town with the same last name signed for it. There is a Mr X out there who receives and keeps a lot of the wrong packages. Also had a lot of items that were so damaged the serial number got changed.

Give the guy once chance to make it right- and don't let him stall you- after 30 days you have less of a chance apparently. As a seller, I would set up a return pickup from FedEx today, but people are idiots so give him a week. If he can't get his act together, just stop talking to him and file a dispute with eBay. You will get the money back 100%. Don't spend any money or time on it. Just be prepared to have some patience- that's part of doing business on sites like these.
