Default Armed Lunatic Released On Own Recognizance.

Ok. So in my area a man was arrested for impersonating an officer, news copy and pasted below. He was arrested when seen wearing a tactical vest with a badge while armed on a false alarm call. His instagram shows him pulling into State Trooper training centers armed, and impersonating living a life that he is a state trooper. His car is even outfitted with police lights and radio (and of course a thin blue line punisher skull). It turns out he has been doing this for a while, and his instagram is truly disturbing being mostly firearm related or impersonating an officer. How the hell is this a single misdemeanor charge, and this guy gets to keep his guns? Isn't this the exact type of red flag of a person who shouldn't be allowed to legally own a firearm?

"POLICE ARREST POLICE IMPERSONATOR

(Wilmington, DE 19808) Last week (June 15) firefighters from the Mill Creek Fire Company were dispatched to fire call in the unit block of Patrician Terrance in the community of Limestone Terrace.

When the firefighters arrived, they discovered the report of the fire to be false and notified the New Castle County Division of Police.

When patrol officers arrived, they learned from the firefighters that they had been dispatched to the same apartment complex multiple times over the past year for false reports of fires. They also learned that incidents were being investigated by the Delaware State Fire Marshalís Office who developed 25-year-old Shane Windell as a person of interest in these incidents.

The patrol officers also located witnesses who saw Windell, just as the firefighters were arriving, exit a blue in color sedan wearing a police-style tactical vest with a police badge and what appeared to be a holstered firearm. Officers then located the vehicle he exited, it was a blue in color 2010 Chevy Cobalt displaying DE registration 309530. Inside that vehicle, they observed a police-style tactical vest

Detectives from the New Castle Castle County Division of Police Criminal Investigations Unit FBI Task Force assisted by ATF agents assumed the investigation.

Last Thursday, (June 20th) Shane Windell was taken into custody. He was taken to New Castle County Division of Police Headquarters where he was charged with one count of misdemeanor Criminal Impersonation Pretends to be Public Servant Wears Uniform and Badge. He was arraigned at Justice of the Peace Court 2 and released on his own recognizance.

The investigation is still ongoing with the Delaware State Fire Marshalís Office.

Based on this investigation, detectives are concerned that there may be additional citizens that may have had contact with Windell while he was impersonating a police officer. If you or anyone has any additional information, please contact the New Castle County Division of Police at (302) 573-2800"

If I'm his lawyer I'm saying, his gun is registered, his fake badge is just a toy and not against the law, his vest is easily picked up at a hunting or police/fire store and nothing about it is breaking any law. Having lights mounted on his car may or may not be a violation depending on there color, having a radio???

Sure all these things added up sound like an AR 15 looks, but unless he broke some law, why should he not be released?

Apparently he is not a felon, and the only thing they could book him on was a misdemeanor. Based on that, they could take away anyoneís guns for any misdemeanor charge. Iím sure you have a presumption he is innocent until proven otherwise, or do you disagree with that aspect of our system as well?

All the above are true singularly, but added together I would think they add up to Impersonating an Officer. Which I thought was a felony.

It may be that he hasnít crossed a line that reaches the level of the felony. Such as pulling someone over and actually passing himself as a LEO, as opposed to dressing like one and living some sort of fantasy.

Sounds like a whack job on his way to a problem, even if he hasnít gotten there yet.

This isn't a kid wearing a costume. It is someone with a heavy fixation impersonating an officer, while armed, to the fullest extent.The lights are blue and red interior LED like you see on unmarked cars.

Someone who is not, but thinks they are a police officer, and shows up armed, to calls. Shows up to the station to take social media photos to further the illusion. Yes, that is a lunatic. Is this normal behavior to you? I mean that he is impersonating an officer to the fullest extent.

His instagram makes him seem like a normal good dude. Hunt n fish and gun range stuff, typical guy stuff. Wonder what the hell he was doing? Maybe just trying to be a hero or something? Should just get a real job there or volunteer?

This isn’t the first guy to impersonate an officer and there are laws that address it. Not something I would do but then, are we going to start incarcerating people or taking away rights based on your point of view or mine, etc?

or are we a nation of laws?

Key words. " It is still under under investigation" they charged him with something...... They will stack the charges on him later IF he did something..

His Instagram looks pretty benign to me and I dont see evidence there of him being a lunatic..

LMAO. this is your kind of lunatic? You easterners think every guy with a gun is a crazy, when you all should be the most gun-happy-town-totin people around. the original gangsters area that broke free of the crown.

He was probably doing something stupid, yes, but lunatic and "armed to the fullest extent" is quite far-reaching. And tactical vests arent usually armored. A full IOTV with ceramic plates is pretty uncommon.
