Sorry man, this is a tough situation. Good Luck. There is always some risk involved when you put upfront money to any company no mater how strong the company is. I guess the moral of the story is make your risks as calculated to the best of your ability. A great deal on a boat that may or may not be a great boat may be worth it for some. Someone else that canít stomach the possibility of losing the money may only buy a production boat that is already in stock and get a clear title in exchange for the money. To each their own Iím sorry this has worked out this way for you. Thank you for sharing I think that is what this forum is about. It may stop another member from putting a large deposit on a boat without a personal guarantee from the owner or knowing that they are taking a big risk. It certainly caught my attention.

Hey Ray it looks like Riptide has known Kevin longer than anyone here and has faith in him since he’s the reason Yellowfin did so well while he worked there. Maybe Riptide will buy your build spot for 250K and save Kevin’s reputation. My guess is he knows better.

not sure which one though
the Miami show will be nice with Freeman -Invincible-Seahunter-Prowler-Tideline on display
Compmillennia’s new 42 quad boat and Berky’s Will also be interesting
I sea trialed the 37 Invincible a few weeks ago in Sarasota quad 300 yam’s to bad it was slick calm
The fit and finish of that boat and the solid feal definitely got my attention it’s NICE
In the mean time I found a sweet deal on a 39ST Contender trip Vrods to satisfy my cravings

My post said they got nothing for their money. Please list for us what anyone besides Barker got for their investment. He took the money saying he was going to build a cat boat with it. And all anyone has is a pretty drawing of one. Iím not judging Barker as to his intentions, I donít believe he went into this to try to defraud people. But Their money is gone, and thereís not even been one boat started. Iíll never be in the market for a 200k bay boat, but if I was, just those facts would keep them off the list.

After reading through this thread, I started wondering about surety bonds. Would a buyer be able to stipulate that the builder purchase such for the agreed amount of the sale price? And would it be able to insulate the customer from loss?

yes bonds could be bought if there business and them selve qualify
getting a performance and payment bond requires extensive accounting and financial strength though

Thanks for the reply Ray. I hope you are made whole. I’ve had to purchase a performance bond in the past for work I did. I am also the treasurer of an organization I belong to, their bylaws require a (crime) bond on the treasurer, which they pay for. Just got me wondering if it was a consideration in this circumstance.
