Brett picked up a pontoon boat from me a year ago to sell. I was told several months ago it sold and he would be by to pay me and pick up the title. Have yet to see him, the business phone is disconnected and he won't answer his cell phone or return voice mail. Yes, the one in englewood, Fl. Their LLC has a Fl Admin dissolution for not filing an annual report!

Not to sound like wridman in making my ASSumptions, but they would go like this.

You had the boat surveyed or had an acquiantance inspect the boat or you just had faith and believed the boat was in the condition the marina told you it was in. You had some sort of shipping arrangement or pick-up planned. When you felt comfortable with your pending purchase and arrangements, you wired the $30k and the boat was to be shipped or picked-up according to your previous arrangement.

Now is where my question comes in. Was the boat shipped or picked-up and currently in your possession and your enjoying it while awaiting the title....or at least in your possession while awaiting the title? Or did your $30k go bye bye and you don't have possession of the boat? If you have possession of the boat and no title, yes I would be peaved. However, if you don't have possession of the boat, I would have already been in Florida for a little face to face, come to Jesus meeting.

Hopefully you are in possession of the boat and this is just a PIA and not a total screwing.

He has already filed criminal charges and is filing a cival suit. Not sure a certified letter would work much better.

Diverboy your words sound just like something I would of said. That part about "a little face to face, come to Jesus meeting".

That's country, down home smack language, and business is about to be commecning.....

My wife tries her best to contain me from confronting A-Holes like these, but sometimes a little face face, come to Jesus meeting is what it takes for them to understand what is meant by a business transaction with me.

I will caution anyone reading this that A-Holes that try to scam others are to be dealt with carefully. You never know what they might pull out on you, in a face to face, a gun or knife, and kill you. They just don't care.(There, that's what my wife would say, which we all know there always right) So let's say he gets away with it this time. Well, this country boy won't forget and were pretty damn good hunter's too.

Sounds to me like the guy who got 30g's isn't gonna pay off the bank.. And according to the OP, he had the title in hand and didn't owe the bank anything...Doesn't get much shadier than this.. Around here people like this get referred to as crabpot bait.

I knew it, I was born in SW Georgia till 5, grew up in Altamonte Springs, that's about 50 miles away from Brooksville, and now reside in Ft. Lauderdale.

Memory serves me right we always had a good High School Baseball game with Brooksville....Always like Brooksville, Country feel about it in Florida.

Show up at the dealer and inform him that he has the choice of either giving you physical possession of the boat right now or he wires 30K back to your bank as you watch - that money is spoze to be in escrow for the owner - be polite but do not take NO for an answer...
If you are not willing to stand up for yourself, don't expect anyone else to do it for you...

And if he says no what does he do, pull out a piece? Even worse the seller could have his security guys toss him off the premises. It may work (I suspect not), but this approach is no guarantee.

I bought a pontoon boat from Brett Hyde, Sun Harbor Marine, in August of this year. I drove 2 hours down to Englewood and told him I was not leaving until I had my title in hand. Lots of lies and over 3 months later he reluctantly gave it to me. Long story short - the guy is a liar and thief. I'm sorry to hear about your boat - makes my mere $300 that he owes me seem like nothing. I have a lot of choice words I would like to say to him.

Find out when the "dealer in question" is attending his next boat show. Rent the booth across from his and get a LARGE banner expressing your dealings. You'll have a check in hand before the show opens!

Careful about a face to face meeting with somebody who has screwed you out of $30 grand ... as he stands to gain MUCH MORE by suing you after you assault him and he comes up with some lame excuse for why it's totally legitimate that he screwed you ... but your assault has cost him his ability to earn a living .... and on and on.

I'll be in court next week over a $59 billing. We are going back and forth with attorneys over the fact that I responded to an email in 2 hours instead sooner. I have spent $15k defending the case. If it goes to trial, it will be $30k plus.

And .. the plaintiff wants $20k to settle! And I didn't do a thing.

I don't blame the mess on the plaintiff ... blame it on the lame ass politicians that allow this mess.

Either way ... when you are getting f***** you are most vulnerable of being taken to the cleaners for much more.

Wondering if the pontoon boat CaptainKurtG bought has correct title? August was about when I was told my pontoon boat was sold and he would be up with the money to get the title. Describe boat and or contact me to send pic. Very interesting!!!!!
