It sounds as if the neighbor was asked by the homeowner to investigate the cause of an alarm. Because of that, the neighbor was, in all likelihood, legally entitled to enter the home. If he was then confronted with a situation that caused him to fear for his life (in a place where he had a legal right to be), he would be entitled in many states to use deadly force in self-defense.

The key argument would be that the neighbor didn't go looking for crooks, he went looking for the cause of an alarm and wisely chose to arm himself in case there was a threat to his personal safety.
