Default Striped bass commercial permit question

I've had a commercial permit for many years, just not in the past 5 years or so, due to being in the military and not being around much. Now, I understand there may be some serious changes this year. I understand there are some potential control dates to even get a permit this year.

1. If I had a permit years ago, before the control date, will I be able to get one this year if they makes those control dates official?

2. The proposed changes say boat permit holders could change to as little as 10 fish per day and rod and reel permit holders to as little as two fish a day. I fish from a boat and if these changes happen, should I get the 0-59 boat permit or the rod and reel permit? I've historically had the rod and reel license as I fish alone. But the new changes make it sound like if I get just the rod and reel permit, even if fishing from a boat, I'll only be able to keep and sell 2 fish. Am I correct? Will rod and reel permit allow me to sell 2 or 10 fish if it takes affect?

It's my understanding that you must have kept the permit current since before the control date, but there is only 1 way to know for sure.


Neither question you've asked has been decided on . . . there is a meeting Feb 11th in Plymouth for public comment. My best guess is that a 9/08/13 control date will be enforced. Please report back when you hear from DMFS.

Thanks Tim, just spoke to them and they said the same thing you said. Nothing has been decided yet. They said my best bet is to see what happens after the meeting. I have the 15th of March but I was hoping they had some what if scenario answers. I guess I'll just ask at the meeting.

What I'm curious about....

If you've had a R&R permit, active up through 2013, can you now get a boat permit in light of the pending changes or will they try to keep you limited to your R&R? Anyone find this out yet? Not looking for speculation - curious to know if anyone has asked the question to DMF. I guess I'll find out Friday when I renew...but that's been a thought of mine.

I just called, they said fill out the boat app then apply for a rebate on the rod & reel permit.

UPDATE:

So, I just got a return phone call from DMF in Boston re: this above situation. (maybe he reads THT :-))

Anyhow, I was told that if they institute this 9/2013 control date, the control date will apply to the "Striped Bass Endorsement" and NOT the type of license. So, if you've had an individual R&R (up through last September), and you own a boat, you will be able to get the BOAT permit and your bass endorsement history will carry on to that.

The history is w/ the endorsement - license choice year-to-year will determine how many fish you can sell (if they adopt that part of the proposal).

What if you don't own but borrow the boat with an existing boat permit? The boat I use has the boat permit and I ran it under a rod and reel permit.

FORDY: from what DMF told me today, the control date will apply to the striped bass endorsement; does not matter if you have R&R or Boat permit; it is the endorsement that carries the history. If you were R&R last year but this year want a boat permit - you can get one. That's what Boston DMF said anyhow.

I can't speak for him, but I'm pretty sure he has a registered boat. The way the rod n reel permit works is you can fish on someone else's permitted boat or on your own boat that is not permitted but you have to fish alone, the rod and reel permit does not cover anyone else on his boat or another's. now it seems they are trying to close that provision by only allowing rod n reel permits 2 fish.

I called Div of Marine Fish, I can get the boat permit and might need an approval letter from the owner to change the name on the permit to my own. Then they said I would need to apply for a rebate to get my $65 refunded back. Until they change the rules then I will take the necessary steps to change it. The boat permit does have a history of Sea Bass landings but I missed the boat for that endorsements so that might carry over too.

John, I'm actually covered as the operator and here's the real kicker....I could of Sea Bass'd last Summer too!
