The Associated Press is reporting that the trainer's boss is blaming the Trainer. She apparently allowed her pony tail to dangle/float in the water while talking to the crowd.

This particular animal has been involved in two other deaths. Regardless of how many feel about them, they are wild animals taken out of their natural habitat. Something that large and powerful can kill without any effort, even if they are being playful and do not intend to injure.
The best thing they can do is release it back into the wild.

i just read that trainers are not allowed to be in the water with this particular whale. she was laying on a shelf when he grabbed her pony tail. also, is this a poor choice of wording? kind of surprised its still up.
