Default Is the Government getting out of control?

I called the the County Solid Waste Services yesterday. I wanted to find out what to do with a stack of tires on my property. The woman I spoke to was extremely knowledgable, and friendly. She asked how may tires I had, and I told her, "I would guess about 15 to 20".

Before we ended our call, she said if your "private" and not a "professional", don't carry more than 24 in your trailer. Without the proper business permits, you can get a $500 fine for transporting them. OK, that seems reasonable.

Now here's the kicker. She said," and if the DOT officer is having a "bad day", he can confiscate your vehicle and the trailer....

WTF? For taking 25 tires in your trailer to the dump to be properly disposed of? They can take $30K of personal property? It seems like no good deed goes unpunished. I know she meant that it rarely happens, but why should my rights depend on someone having a good day, or a bad day? I'm seeing more and more of this. Look at the overbearing legislation for bottom fishing off Jacksonville. Tracking devices on boats, ect. This is starting to get out of hand.

Even this is crazy! You are not transporting them for hire, you are legally disposing of your private property. It's none of the governments business how many of your own damn tires you want to carry in your own truck down the road that you paid to build. They are so out of control that it's crazy. They need to remember who puts food on their tables.

You have less than 25 - relax. I would think they would let you go anyway - I mean the real alternative to not having a way to get rid of them is to have people just dump them off the side of the road - anyway this is what the court system is for - in the unlikely event they tried to take your vehicle it would surely be thrown out in court.

In the old USSR, BTW they would retread and recycle those tires until there were only pieces of steel left. Or they would be burnt for heat in the family stove.

Thanks, 240 LTS. I'll look into that, maybe they'll come out and get them. I had someone comeout yesterday for an old Fairlaine.

bobb and ISLANDER11, I think you know it's not just this one thing. Every year I feel less like a property "Owner", and more like some kind of feudal surf that the government "lets me live here". When I first bought this property, cops, government agents, and even meter readers ( I have two meters) acted very respectfull of property owners. Back then the cops had the one "bubble gum machine" cars , and they acted like Andy Griffith. , I don't know, I just see the change. Even the meter readers act like they own the place. Maybe I'm just getting old...but hell I'm still in my 50's

LI Grunt, the problem is, every year they put more of these crazy laws on the books, and you don't even know about them. At all levels "Lawmakers" think it's their job to "make laws", and so they do. Sometimes hundreds of them. Most citizens don't even know who the Governer or Vice President is, so what are they going to say...BTW, you never see them rectract the old laws, so every year there are more of these BS laws that you don't even know about.

I had an interesting experience a few years back. A "Leadership Class" spent two days in the State Capitol, where we met with our State Representatives, Senators, the Speaker of the House, and some other officials. Our State Rep indicated that the session had passed 940 pieces of legislation. Most of the other participants seemed to think that meant the Reps had worked hard; I asked "What rules did you repeal, since I can't believe that we needed solutions to a thousand new problems?" He was taken aback by my question, and couldn't answer. Still amazes me that anyone could think that our state needed 1,000 new requirements...

I will give you some background on the State Waste Tire Law you speak of chapter 67-711.200... It has been around since at least the early 1990's. One of the many duties I had as an FMP Officer (back then) was to investigate dumping violations or Litter law complaints. This law applies to used tires. Its main purpose is to help stop the fly by night tire haulers that were dumping in the woods and on private property... As a LEO it is very easy to see where you are going with your load of tires (dump or proper waste station) and check to see if you actually went there later... I can assure you this law is not abused by 99 percent of LEO's. But yes, 25 or more tires and you are in violation without a Waste Tire Decal from the State of Florida

The other side of this, as cracker is saying, is the building of illegal dumps. When I lived just north of Philly there was an illegal tire dump under I95. It caught fire and basically melted I95. Can you imagine what that did to the traffic system. If I remember correctly there were detours for a year while they rebuilt.
So I guess they are trying to prevent people from building and managing illegal dumps, which can be dangerous.
I would hope the LEO would talk about it, check it out especially since you could prove that you had made calls about dumping them, and let you go.

Menzies, that's all well and good. It's all these little, stupid laws that make us all criminals that bother me. For example, when I was young I got a ticket, driving my Fairlane500 (Wide tires, headers but not loud) through a city known to be "upscale". The offense? Crossing a solid white line. No problem. Have you noticed how they paint roads, especially the new ones, in Florida today? The solid white lines are ubiquitous. Often it's virtually impossibe to get where your going without crossing one. And the entrance and exit lanes; they can be 50 yards in length, but 45 of those yards are separated by a solid white, usually at the very end (Merge), or very beginning (exit). You would have to drive like Michael Shumacher to do it at speed.

My point is, if the law say's don't cross it, why design the roads in a manner that virtually ensure your doing so? Those of you familiar with 95 in Daytona may be familiar with a solid white that goes for MILES; making it virtually impossible to enter on International Speedway and exit at SR420. IMPOSSIBLE.

And Cracker will correctly say that 99.9 % of the cops would never enforce it. Doesn't matter. If it's the law, paint the roads so we can obey. I shouldn't have to be forced to cross a solid white, if it's illegal.

End of soapbox rant...

Don't worry. When it's mandated that we all drive rollerskates that won't have room for a spare tire no less haul a trailer with 25 tires, you won't have this problem anymore.

Re the solid white lines - I agree 100% and always wonder that myself. Its the exit lanes that get me - whe exiting a main road there is an exit lane either to the right or left, the actual dotted-line "window" they give you to get into that lane is about two cars lengths!

Sounds like a good law if you have ever had to haul stacks of used tires off your property out of a wooded stream that were illegally dumped in the middle of the night. Wasps love tires. Ask me how I know.
I could never understand why they dumped them in the stream when they didnt have too...
They should create a law to stop folks with carloads of pets they intend to drop off too.
One thing I love to do is go thru the piles of household trash...Dum azzes always leave stacks of envelopes with name and address. Easy to look up in the phone book and leave a message that you are calling the state police. Usually gets the garbage picked up quickly.
Maybe a tire tracking process is needed.
