Default Supreme Court to Look at Local Gun Laws

WASHINGTON (Sept. 30) -- The Supreme Court agreed Wednesday to decide whether strict local and state gun control laws violate the Second Amendment, ensuring another high-profile battle over the rights of gun owners.
The court said it will review a lower court ruling that upheld a handgun ban in Chicago. Gun rights supporters challenged gun laws in Chicago and some suburbs immediately following the high court's decision in June 2008 that struck down a handgun ban in the District of Columbia, a federal enclave.
The new case tests whether last year's ruling applies as well to local and state laws.

The 7th U.S. Circuit Court of Appeals upheld ordinances barring the ownership of handguns in most cases in Chicago and suburban Oak Park, Ill.
Judge Frank Easterbrook, an appointee of President Ronald Reagan, said that "the Constitution establishes a federal republic where local differences are to be cherished as elements of liberty rather than extirpated in order to produce a single, nationally applicable rule."
"Federalism is an older and more deeply rooted tradition than is a right to carry any particular kind of weapon," Easterbrook wrote.
Evaluating arguments over the extension of the Second Amendment is a job "for the justices rather than a court of appeals," he said.
The high court took his suggestion Wednesday.
Justice Sonia Sotomayor, then an appeals court judge, was part of a three-judge panel in New York that reached a similar conclusion in January.
Judges on both courts — Republican nominees in Chicago and Democratic nominees in New York — said only the Supreme Court could decide whether to extend last year's ruling throughout the country. Many, but not all, of the constitutional protections in the Bill of Rights have been applied to cities and states.
The New York ruling also has been challenged, but the court did not act on it Wednesday. Sotomayor would have to sit out any case involving decisions she was part of on the appeals court. Although the issue is the same in the Chicago case, there is no ethical bar to her participation in its consideration by the Supreme Court.
Several Republican senators cited the Sotomayor gun ruling, as well as her reticence on the topic at her confirmation hearing, in explaining their decision to oppose her confirmation to the high court.
The case will be argued next year.

So in other words, Constitutionally protected rights can be given or taken depending on the political climate of the area in which you reside.
If that were the case then they could do away with all gun rights through state and local ordinances regardless of the 2nd Amendment or the Heller ruling from last year.
What a buffoon!!! And to think these people swear to uphold the Constitution.

Hey that makes me think, since that 16yr old was beaten to death by a railroad tie in Chicago, we should make sure everyone who must purchase a railroad tie has all the correct permits, proper I.D. must wait at least 7 days for a railroad weapons check, finger print them so they go into the system, make them take a railroad tie carry class. That would stop all this railroad tie violence.

WHAT!?! No. The constitution says the states can go out and make laws to their best ability as long as those laws do not infringe upon the rights listed here.

A solution for high school shootings would be metal detectors at all entrances. Kids that wanted to bring guns on campus would get around this though. Armed teachers (the ones that are capable) would cut down on the number shot. Anywhere else in public, college campus, bars, malls, restaurants, airplanes, if a % of the general public was armed would cut down severely on the number of shootings. That gook that shot up Virginia Tech killed over 30, no way he would have killed near that number if some students and faculty had been able to return fire.

Todd Henry, 50, was stabbed in the neck and shoulders in a classroom at John Tyler High School a little before 9 a.m. CDT, according to police.

The attacker, who is in custody, has not yet been identified. Police haven't said whether the suspect was a special-needs student or what led up to the attack.
Henry was in the classroom with a paraprofessional and three students, one of whom is the alleged killer, said Randy Reed, superintendent of the Tyler Independent School District.
Following the incident, Henry was rushed to a local hospital. The school was placed on lockdown and the student was taken in to custody by school district police.
Reed said the attack was "not gang related or racially motivated. All reports suggest this was a random act by a single student."

I know a local machinist who made a fully functional semi auto pistol in his backyard shop, including the springs. Marijuana and meth are illegal to manufacturer, possess or sell - gee - how well is that working?

If you outlaw guns.........only outlaws will have guns

A criminal on his way to rape, rob or kill already plans to break the law. You really think he cares about breaking a gun law
