Default Finger Dock collapsed while stepping on it. Has this ever happened to you..

I dock my boat at the Brielle Yacht Club in NJ. On Friday I went to check my lines and stepped on the Finger dock and it just collapsed under my feet. It was Low tide and I fell about five feet. I broke my ankle, tour my knee, shoulder and cracked ribs. So this happened last Friday morning at 7:00. They never even called the guy next to me to tell him to be careful the dock is not safe to walk on. I know this because I went done to the dock and all of the wood was still floating and the guy was there and he told me he got no phone call. If he went down that night he would of stepped on that finger and who knows if he would be here today.. I'm just lucky that I did not hit my head on either boats or I would not be here right now .. I just can't believe this happened to me.. Have you heard of anything like this before? ??

Negligence. Go talk to the guy in the marina that owns the boat named "Sea Trial" or something like that.

Don't dock your boat in run down marinas, I moved my boat this season because I got tired of wondering if my guests would trip and fall on a dock board sticking up on one end.

That sucks

I've seen it happen at my marina. They are replacing sections of the bulkhead yearly, but it takes time and $$ ot do it all.

When I saw it happen, the guy got away with some nice scrapes and bruises. In your case, they should at least cover the medical.

So get this.. My partner of my boat KNOWS the Dock Master from last year and has complained to the owner that these docks need repair and he said the owner does not want to spend the money to fix the place.. How messed up is that So I have to suffer because the Multi Multi Millionaire is cheap.. By the Way this is a prime place to dock your boat. Most expesive place on the Manasquan.. FFFF Them.. cant believe it!

Not that I am an ambulance chaser but I would be all over the owner of the place. You pay dock fees which are supposed to cover them maintaining the facilities to some level of safety. Yes, accidents happen but any dock owner knows you have to inspect the integrity of the wood since it does rot. That is a case of neglegence. I am thinking at least get your medical covered and maybe some consideration when it comes time to negotiate next years dock fees.

Just an added comment, my slip is ownerd by a guy who owns a couple restarants and the dock behind them. He does checks the property consantly and makes repair immediatly when needed. I found a loose board a while back and within ten minutes he had the saw horses out and was cutting a new section. He also went over the rest of the docks to be sure there were no others. He probably could have just put a couple of nails in it an been fine but he replaced with fresh wood and did it fast. It only takes a few minutes to do but it can avoid a lot of problems, such as in your case.

If you filed your complaint in writing, you should contact an attorney. It will be a slam dunk which will cover your expenses and most likely get you some compensation for pain and suffering. Your health insurance provider may do this for you when they find out your injuries were due to an accident on someone else's property. That way they won't have to pay your bills, the property owner's insurance will.

In today's society, those waivers are only worth the paper they were written on. Especially in a case of gross negligence such as this. If it was something stupid that the boat owner did, the waiver may hold up, but for something like walking on a dock?!?! If I was him I would start pricing out new boats so I knew exactly how much I wanted to sue for.

I would definitely go see a lawyer I'm not the type of person to sue but you have every right to here you pay dock fee's for maintenance of the docks and other stuff it will teach the owner a lesson on letting his docks go to sh!t

I wanted to put that kind of language in my rental property contracts. My lawyer laughed out loud.

Same with the signs at my golf course that say "Golfers responsible for all damage casued blah blah blah."

I hope some day I hit an inadvertent shot through the plate glass on the clubhouse just so I can tell them to go perform an unnatural act with themselves.

Pure and simple, the waiver does not cover negligence on the part of the owner. Get pictures immediately of your injuries, dock etc

it is called open and obvious you knew or should have known about it, At least 50% your fault. Sorry it has caused you such pain, I have been there and done that. Boating is know to be dangerous and that docks are wood and over water and they can fail. on and on it goes. Good luck

Not quite how it works. In fact, that is an idiotic statement. "Boating is know to be dangerous" and docks being over water have nothing to do with it. Open and obvious is when you walk down the dock with a huge hole in it and fall in the hole.

You need to go see lawyer. There are laws concerning maintenance and upkeep of property and damage done to those utilizing it. "Premises liability" is what it is called in La. Here, the owner is strictly liable for such things. In other words, you show you got hurt on his property, and it is then HIS burden to show he was not negligent.

Nothing wrong with being compensated by a person whose negligence has caused you pain and money.
