That probably would have not worked out very well. Especially if the guy was unarmed and made no attempt to attack you.
WTF???!!!

If someone breaks into MY house at 1:00 A.M. while my family is home asleep that person will leave my house in a body bag.
In an situation like that nobody know to who fix the body bag. Normally when you awake up the senses aren't 100% and this very important time frame to make mistakes and they know, he is in maxima alert.

Having done thesis papers on concealed carry laws and permits, i will offer my .02 for what its worth.

A lot of good advice has been mentioned, and also a lot of male testosterone.

When it comes to the law itself, by book standards, imminent threat or danger is the correct word used by others in this thread. If you come down stairs to catch a guy holding your dvd player and hes half way to the door when you decide to squeeze rounds off, you better kill him. Bc you def dont want his word against yours in a court of law and your going to have a tough enough time defending your case to the DA. Also you can bet your A$$ his poor broke family will try to sue you for wrongful death.
A good thing to keep in mind would also play out when you come down stairs to strange noises and the back door si being jiggled and opened as you flip the lights on in the kitchen the intruder is caught surprised after just opening the door. A mere second passes during this startlement, you look down in his hand and notice the screw driver he used to break the lock, in most DA and Prosecutors minds (and all jury members) that one second that passed and he hadnt bolted was to long. You could justifiably pull the trigger until the clip runs out, since that screw driver is a weapon now, and imminent danger could come from nonaction on your part.

How would it play out in my home? I honestly dont know (i like the you can bet his prints will be on atleast one kitchen knife comment)
-Would i act according to what i know to be the law? tough to say, with that much adrenaline things become blurred and happen fast.

I do know my motto has always been.

If you threaten me or my family, whether its at home or the gas station, may god have mercy on you because I wont.

You know kids (never your own) do go through stages. It would be a shame if the kid you killed was your next door neighbor's son or daughter. I am talking about a situation were there was NOT actually imminent danger, but you were firing to make a point. A very good movie that illustrates this point is "American Gun." It might have been James Coburn's last movie. Check it out.

Get an alarm asap so you'll know the house is not being compromised during the day while you and your wife are away. Did the perp see your weapon? This could be good or bad. Good because it may have scared him but bad because now he may come back to get it while you are away.

A good alarm system should allow you to set it at night so that you can sleep in your bedroom while protecting the rest of the house but these can be tricky if you have pets or kids.

Shoot the intruder. Then shoot any lawyer that questions your need to shoot the intruder.

And you will leave your house in hand cuffs.

Just because someone is in your house does not give you the legal right to kill them. If you shoot an unarmed man in your house and kill him your gonna have a hell of a time talking your way out of it.

I don't care what you do it's your house. But, you don't need to give people on here the idea that it's legal to kill just because they are in your house.

In Georgia, you can smoke his azz if he's in the house. Maybe even if he just outside a little bit where you can pull him back in a little.

There was a day when I never even give a burgler a chance in he11 of getting the upper hand on me. Too well trained and too well armed. But as I get older I sometimes wonder how it would go down. I'm sure I would just shoot him before he got close enough to fight with me or to stick me.

This is the second statement like this and it puzzles me - I'm curious - why? For your average crackhead (or even your above average theif) why would a gun be more "desirable" than a rolex, plasma TV, shiny new car, or a wad of cash?

A weapon on the street is like crack to the criminals. They usually have a record which limits their ability to obtain one through the proper channels...plus THEY ARE CRIMINALS, so obtaining one through proper channels is not even an option. Who wants to commit a crime with a weapon that ballistic experts can trace to a particular weapon and find it was sold and registered to you??? Plus it goes nice with the pile of cash, rolex and anyother "bling" that can be obtained. And in these "circles" a weapon holds more value. it's tough to rob someone at "rolex-point"

Ever hear of a "drop gun"... I'm sure some of the LEO's on this board know what I'm taking about.

Cuda,

You did the right thing. Screw anyone else who is Monday morning quarterbacking your response and saying they would have done this or that.. No one knows what they would have done in that situation unless they've been in that situation. Due to my career choice, I've been in a few shoot-don't shoot situations in my life. I always laugh when people say, "Oh, I would have smoked him," or "They'd be leaving in a body bag if that was me." When, in fact, most people simply do not have the psychological ability to kill someone regardless of their life depending on it or not (read Lt. Col. Dave Grossman's book - "On Killing."). And if/when you are in a situation where you feel you need to defend your life (or someone else's life) there will always be those people who will criticize your choice, too... It's a crappy situation to be in. In this case, you clearly didn't think your life was at risk (and it obviously wasn't) and you reacted appropriately. You were clearly ready to act based on the suspect's actions, and as you wrote if he would have made a different choice, that would have been dealt with appropriately...

Best advice that was given was to get some motion sensor lights and an alarm... Even if the alarm is not monitored, just the audible alarm itself will deter a burglar... And in their mind, if the lights are on, everyone can see them.... And don't blame the dog, either He didn't know what was going on! You gotta train him to react to those situations, even if it's just sitting there and barking, that can certainly deter a potential burglar as well....

To the original poster, the worst part is the stress going forward. Your wife will never feel 100% safe in the house again. After our neighbors house was broken into 3 years ago, we immediately installed motion sensor lights and a monitored alarm system. At first I balked at it, but I am really glad we did it. The $20-$30 monthly monitoring fee is peanuts. The monitoring signs don't hurt either. Although a break-in is scary at night when you are home, most occur during daylight when many people are at work. We have a lab mix and she sleeps in our room with the door shut,(cat is way too tastey) so she might not hear somone at night, but during the day no one in their right mind would want to confront her.

I think the guy handled it well. He was absulutely prepared to take the intruder down if the threat level elevated. My preference would have been 12ga 00 buck.

Nobody got killed or tied up in a huge court battle. The stress of possible prison time while the battle played out in the courtroom probably outwieghs the jitters he has about the guy coming back for more.
