cudacat, hopefully this guy now realizes your residence is armed and will never come back. I can certainly understand how you feel less secure.

I have a 2 story house with the master upstairs. One staircase. My wife has a 12 guage and I have a 9mm. If ever we have a home entry I plan to make the upstairs my fortress. If the person comes up the stairs despite my warning to leave the premises then I will assume nefarious intent and will defend. This will also allow me to identify my target and my defensive position is in my favor. I am not interested in going downstairs expecting to see one guy and get surprised by another and give away my advantage and possibly losing my life.

If I know somebody is downstairs, I dont plan on going down there to confront them. I am not looking for a fight...just want me and my wife to live. Items can be replaced. If I have to shoot someone I want to make certain there are two things that are clear....that I am definitely in danger and that I will have no regrets later. If someone tries to come upstairs that fulfills both of my criteria.

There have been a lot of arguments about a 12 guage as a home defense weapon being too long and unwieldy. In our case it is not a big issue because I dont plan on having my wife sweep the house with the 12 guage. She is also very comfortable with this gun.

Louisiana has a "shoot the burgular" law.

And yes, by all means, let the intruder go peacefully and freely into to the night so the next time he can break into your friends, parents or childrens house.

Depends on what state you live in.... In Florida the rules are pretty favorable for the homeowner (castle doctrine) although there must be some perception of immediate danger. I have young children in rooms all over the house and an intruder would be perceived by me to be a threat if they were between me and my kids. I would not relish the idea of shooting someone but I would pull the trigger if necessary. I prefer not to expose my kids to that scene though.....[/quote]


I agree, the rules are fairly favorable here (SC) as well. However, you must feel like your life is in immediate danger in order to shoot/kill. It would be tough to say that when your dealing with a totally unarmed man. It's you against him not you against his knife or gun or screwdriver or whatever.

If you really wanna shoot now and ask questions later have your wife do the deed. She has a much better case against an unarmed man than a typical male does.


Here is a shoot now ask questions later story for you.

This happened a while back and was told to me by my concealed weapons instructor.

A man hears a noise in his house one night while him and his wife were asleep. His kids (he assumed) were all in there rooms sleeping as well. The kids bedroom doors were closed when the man passed on his way to the kitchen. When he enters the kitchen he finds a male standing at the refrigerator. It's dark and he can't see, but assumes it's a burgler or an intruder. Well, he shoots him killing him dead. He asked no questions, did not look for a weapon, and just assumed the dark silhouette was an intruder.

Well that dark silhouette was his son. And the man that shot him his father is now in jail.

Of course there are a million other things this man did wrong besides just start shooting. But, my point is you should be careful about just shooting an intruder. It will most definitley be a life changing experience.

The same type of thing happened here in Ct about 6 months ago.
The guys daughter was sneeking in the cellar window at 3 in the
morning and he shot her with his 9mm. Luckily he shot her in the leg
and she is OK now. This guy was a cop.

Just because someone is in your house does not give you the legal right to kill them. If you shoot an unarmed man in your house and kill him your gonna have a hell of a time talking your way out of it.

I don't care what you do it's your house. But, you don't need to give people on here the idea that it's legal to kill just because they are in your house.
I am sure there would have been atleast one kitchen knife with his prints on it.

#3 When you grabbed your gun you should have been or understood to have been in a position, at least cognitively, to use it.

I am somewhat joking but when you get a gun you should be prepared to use it. What I read from the description you provided is that you GAVE the THIEF the OPPORTUNITY to have KILLED YOU and maybe cause harm to your family.

After it was over, I asked the cop what my rights were, and he replied that I had to feel threatened or in imminent danger, but the burglar did not have to be armed. The intruder never presented a frontal target to me. He bolted and ran as soon as he saw me. The cop said I would have had a difficult time explaining myself being in imminent danger when the bullet hole was in the intruders' back. All that being said, both my wife and myself are proficient with all sorts of firearms. We shoot thousands of rounds a year through shotguns, rifles, and handguns. After contemplating my actions for a few hours, I would do it all over just as I did it then. You are half asleep, there is dim lighting in the house, I get up once a year to look for a noise my wife heard, so it really shocked me to find someone, especially since the dog neglected to take notice, and it happened in a split second. I saw the guy for half a second before he took off, and he was out of the house in a second - not a whole lot of time to think. Had he not hauled ass - if he had stopped and faced me for a second, I am quite sure he would be dead. And yes, both my wife and I are worried he will return - and I feel bad for anyone else's house he may burglarize. I have imagined this scenario many times - you don't keep a loaded 9mm by your bed (no kids in house) without thinking this might happen. I actually reacted about like I had played it in my mind - no confrontation - no shoot. It happened much quicker than I would have imagined. I am replacing the locks this evening and installing one of those beepers when the door opens. I don't know how he got in - my spare key was in its hiding place, but that does not mean someone else does not know where I hide it. Believe me - after this happens - you think of a lot of possible suspects. Don't come by my house tonight - me and the wife will probably be a little on edge.

Same this time. But she turned the corner and saw my 76 year old mother who was coming in first. The front legs dug in, back legs splayed, hackles up all down her back and teeth bared. I had to jump in front of my mother quickly!
We let her roam the house at night.

It occurred to me. I wonder if statements on a forum like this are discoverable.

For example, someone actually has a break in and shoots a person and their posts are discovered and presented in a court case when that person is trying to defend themselves.

Sorry about the shakeup. I am sure it's a little un-nerving.

Now for the facts:
They'll be back...except next time armed. Why will they be back? because THEY now know you have something they want...a weapon. I don't mean to scare ya more, but they are going to say "yo man, we be snatchin the goodz, dog, when, SNAP, hommie comes round da corner wit a 9...shit my ass be bustin da door." And he will be telling this to someone who usually is a step or two up the latter from him on the "flowchart" if you know what I mean.

AND GET RID OF THE 9mm or use it as a secondary weapon. Get yourself a shot gun. the sound of the chambering of a round will always make a bad guy wonder what the hell he just got into, even if he is armed.... and it is going to be easier for you to deliver a round to "stop" the threat if yo ever decide to squeeze the trigger.

It is time for you to REALLY LEARN the laws of your state. Hopefully you are in Texas or Florida...

Glad everyone is ok. Not to sound like a tree hugger but you are prob. better off not killing him. I don't think dealing with that on your mind would be better. I agree with SeaCraft. There is nothing I would fear more than hearing a shotgun shell chambered with the intent of it being used on me.

Glad you are OK. We've had a couple weirdos come up to the door lately so we put one of these in. You can't get within 40 feet of the house without setting it off. We had one before that just beeped but this one will tell you which sensor was set off so you know where to start looking.

WOW!! Glad your OK!!!

Here's something that happened a couple years ago to my buddy.....just a heads up to how clever thief's get........

He came home from work one night and his gas grill was gone. That weekend he & and his wife had a party to go to. When they returned his grill was back with a note and two tickets to the Red Sox. The note read "they were having a party and needed a grill, saw yours and took it. Here are two Red Sox tickets to show appreciation. The game was 3 or 4 weeks later. My buddy being the trusting individual that he is took his wife to the night game. They returned some time after 1:00 AM and their house was completely cleaned out. TV, stereo, jewlery, all the drawers emptied etc...........

Sucked bad!!! Bastads!!!


As times get harder it''s gonna get worse wit htis crap!!!! Doesn't matter where you live!!

I think I would have been inclined to put a shot into the ground on the way out of the house. Seems like the best deterrant to avoid a repeat offender. (short of actually shooting him)
