Friend is buying a condo that has a dock skip near oakland park and the ICW - can he rent it out or is that illegal in Ft laud? I know no live aboards, but....?

Here's how it works in Martin County. There is no specific legislation against it. but code enforcement considers it an inappropriate useage according to zoning. A prohibited activity. You can't rent an apartment in single family zoning,you can't rent a garage, you can't rent a dock. however, they don't pursue it unless a neighbor complains. Broward may be different. of course. The point is..don't expect specific legislation to prohibit it.

i think you can in jax,not sure if it's legal though.i have a friend who bought a condo with flipping it in mind well you know what happened there.anyway he is renting the condo out to one person and the slip to another.

I think the more pertinent, and first question you need to ask is whether the condo association will allow the dock rental. They are much more likely to be hard-nosed about it than the city is. I am not sure about the answer to your specific question, but there is a maritime attorney who writes a column for The Waterfront News and he wrote about dock rental, in general, probably about two years ago. He had some good points which had an impact on me given what I do for a living:
1) Insurance. What if the person you rent from slips on your dock and gets injured? Will your insurance policy cover you?
2) Hurricane: What is the responsibility of the lessor and the lessee in the event of storm.
I am sure there were other things that were mentioned in that article, but I cannot remember all of them. You may want to try to look up the article or contact the paper, it's a local one for us.

Insurance and hurricane..good points Barrister. My neighbor rents dock space "illegally" but no one complains. she had a blowboater renter who complained a tree blew down in a recent hurricane and damaged his boat. Wanted my insurance to cover it. It wasn't my tree, and he was there illegally. Only a couple hundred dollars damage. Point is..there ARE liability issues involved with strangers, their boats, and their guests.

there is specific language in the city ordinances governing this. i don' t know the statute # but if you go to municode online you can search for the sections in the city ordinances and see which apply to you. start with the HOA as others suggest.

BINGO...condo assoc. is first concern...our assoc. does NOT allow rental...mostly due to liability issues and security issues..(stranger on premises,etc.)...
