Which video were they watching? Certainly not this one.
I think it is justifiable. Would I have done the same thing, as quickly has he did, probably not but these things can happen when you are confrontational with an officer. Doesnt help when you disobey officers orders either.
Nothing will ever come of it. If the guy files a civil suit..I doubt it will go anywhere unless the state just wants to give the guy a few bucks to pacify him. My guess is that when he gets stopped again, he wont argue and if he does want to..he will wait for court. As fore the trooper.... he can work on his communication skills and if not...go find another job.

Im usually behind the police 100% but while this dope may have been technically justified in his actions, he was clearly not in compliance with the spirit of any regulations. COuld the kid have avoided this--absolutely, does this cop have a low IQ, no doubt.
I'll tell you what-while I don't always like the attitude of the cop that has pulled me over, the yes sir no sir has always gotten me by without a shooting, taser or otherwise. This seems like one of those kids that never got a spanking, never knew his personal limits, ie has problems with authority. When we have serious problems with authority, we vote, or revolt.

I have no respect for a bunch of tazer crazed cops or any authority either. Who should have authority over any of us?, only GOD above. We all should be our own authoritarian, instead of counting on nitwit cops,judges,FBI,CIA, and other Govt agencies, to tell us how to live our lives . What is wrong with you people?

KEEP IN MIND EVERY HIGH PROFILE TASING INCIDENT has been found to be "justified" when the investigating agency was affiliated with the guy doing the tazing, as in this case. And the tazing was also found to be an "unreasonable use of force" when investigated by an independent agency. Even an idiot knows when the fox is in charge of the chick coop all of the chickens are safe; just ask the fox.
Let's consider who cleared that cop: " Gardner's actions were lawful and reasonable under the circumstances," Davenport said at a news conference..."
Note: Davenport would be Supt. Lance Davenport of the Utah Highway Patrol...the very same folks that employee Ofr Gardner, the LEO that maliciously tazerd the motorists.[/b][/u]
Can’t wait to see what the independent investigation comes up with. Me thinks the trooper will be singin’ a different tune in that report’s findings.
Regardless of anyones opinion on the tazing...Nothing will happen to the trooper....If his own department backs the guy and his actions fall within the confines of the departments S.O.P. ..he is okay. No criminal charges will ever be brought...If for the sake of arguement, the D.O.J. ( FBI ) investigates it and finds any wrongdoing...The state would pay the guy some money...thats it. But it would be pretty hard ( pretty much impossible )to find fault in someones personal actions if they were acting within their own departmental policy.

As far as the incident, the officer was probably within his SOP's for deployment but his communication skills were poor. The driver was definitely defiant and uncooperative and letting an upset driver go back to his vehicle before the officer has completed his business is very dangerous (weapons inside the vehicle are a very real concern). Bottomline, as has been stated if he had done what the officer wanted and fought the ticket in court everything would have been fine.
Just a reminder, I have never seen an officer tell someone to do something illegal, copperate with his orders and then complain to a supervisor or internal affairs afterwards if the officer acted improperly. You dont have to agree with the officer but sometimes his orders are to keep you safe, whether it is because of unsafe traffic nearby, or officer safety concerns...

I think TN believes like me (hope I'm not being too presumptive here, TN) that we must have basic respect for authority, but at the same time, government authority is the most dangerous power on earth, and must be kept within certain limits, because it can so easily be abused. Our founders understood this very well. This truth is quickly understood by anyone who spends even a short time on the wrong side of an overzealous (or worse) policeman or prosecutor. You can bet that the Duke boys understand it. Randy Weaver understands it. But most citizens fortunately never get put in this kind of position and this fact can lead to the very mistaken attitude that the police are always right. They aint. They are just people subject to all the same failings as other people, but they have a gun and a badge, which can make them very dangerous.
Having said all that, I put most of the blame for this tasing incident on the young dumbass speeder. He was asking for something, and he got it. The policemant was not the brightest bulb either. This is what can happen when two dumbasses meet, and one has an attitude and the other has a badge.
I say both the speeder and this cop should thank God for tasers. Without a taser, who knows what might have happened here.
