I have been in our new (to us) home 5 weeks now and now have had an AC failure. Despite having a professional home inspection, the unit working well for the first 5 weeks, and the parts needed being listed under the agreement our home warranty company is refusing to pay. They state that there was rust in the unit showing that the problem stemmed from a pre existing condition. Of course it is not a brand new unit but if all the appliances were new, it wouldn't have been necessary for the purchase of a home warranty. Everything in the home was maintained very well as it was previously owned by an engineer at the Naval Academy (detail oriented guy). I now have a $1,200 bill that they will not pay for. The home warranty company is HMS and was purchased for us by our title lawyer (a close friend of ours). I really didn't have a choice in companies as it was a gift but wanted to advise others that these home warranty things are crap, especially ones issued by HMS.
I have notified my title lawyer who purchased it for us just to let him know as I would want to know if I bought something for someone and they weren't able to use it. He plans on calling them but I had to get this issue resolved on my own as we are in the middle of another mid Atlantic heat wave and I have young children and my wife is a stay at home mom.
I had a washer die that I believe was older than I was covered under a home warranty. I wasn't sure if they were going to cover it because of the age but they did...$50 and a new washer. I can't remember the warranty company though.
I think that since you had a home inspection and they did not uncover any pre-existing problem - you should have your claim paid.
I have sold these home warranty plans for years and have only had a few claims turned down. A lot is who they have diagnosis problem - maybe you can get another opinion?
I was forced to use someone they sent out. I am going to have another company rectify the problem though.
It is complete BS in my mind. I need a new coil, drip pan, and some switch. Because there was rust on the drip pan they said it was a pre existing condition. From speaking with them and their manager it is obviously their policy to deny all claims as anything can be said to have a preexistiing condition. Like I said if the place had all new appliances, a home warranty wouldnt be necessary.
Has anybody ever had a successful claim that you know of first hand, not hearsay or "I know a guy who knows a guy" stuff. I don't
Yep, water heater about the first week I owned the home. Ended up being a wash though. By the time I paid the service fee ($75), and the deductible, I could have come close to the same out of pocket if I'd done it myself. Saved me my time I guess.
I've had them in the past (Home shield something) and it paid a few claims, mainly on the HVAC systems. I dropped it after I re-engineered the HVAC systems to be more effective and remodeled the kitchen with all new appliances. I didn't see the future benefit.....
I have one with Total Protect that covers one HVAC system up to $1000. One went out recently and they issued a check for $875 ( took out the $125 bill from the repair man). Of course that did not come close to covering the replacement system but it did help. I wish it covered the second system as I replaced that one last week. I think it may be time to cancel the coverage!
Thing that kicks me in the gut is that I had all new HVAC and appliances in our old house. Time to start over so the wife can have the house she wanted
I had an electrical and an Air Con problem. Old Republic gave me no grief whatsoever. I got the A/C fixed and never sent in the bill because it was a really minor repair (pc board had a device fry), but Old Republic would have paid the dif.
The electrical was taken care of with my total out of pocket expense being the amount of the deductable.
I'm happy with them. Don't understand the ins co diss-allow due to pre-existing. That's exactly what the insurance is supposed to cover.
I think I'd be contacting the state insurance board (or whatever it's called in your area)

My realtor offerred a home warranty on my 50+ house including the appliances. If that's how yours was obtained you should tell the agent you closed with. They may have something to say.

You should really fight this, EVERYTHING in a used home is a pre existing condition, thats what the home waranty is for, if something in the first from purchase breaks.
Not to hijack the thread, but its funny this comes up -- I'm dealing with another issue with the AC and American Home Shield. The AC went out upstairs (we have a separate unit downstairs) last Tuesday. They sent someone out two days later (which is too much for my taste, but within their 48 hour agreement)...turns out the compressor is bad. They seem to be willing to replace it, but I've been waiting for quite some time for the new part to arrive.
It was supposed to arrive yesterday, but now they're telling me Friday. The problem is that I'm just dealing with a 800 call center person and they just can't seem to do anything to give me any satisfaction -- the problem is always somewhere else in the chain.
It's been almost 1.5 week without AC in Houston and its been over 100 the past few days. It has not been pleasant. If I had $1,400 to blow, I'd just use a local person, but hopefully I can save that if I stick this out. Meanwhile, I'm being a pain in the rear to them with my constant calling, I'm sure.
All airconditioners have some rust in them after a couple years. I've been involved with construction/real estate for years, and would NEVER have a "home warranty". Same with home inspectors. Even in florida, where ALL aspects of building are licensed, home inspection is completely unregulated.
I got an HMS warranty on my house that I bought 2.5 years ago. In the first year they covered a new Compressor unit, air handler, a condenser coil in another air handler, hot water heater and dryer repair. Yes, the deductible costs, and the contractors try to upsell you.
I looked up all the replacement parts on the net. Had to fight and deal with many customer service reps, but each replacement just cost the deductible. The heat pump compressor that was replaced was 20 years old. It obviously had rust, and don't know what gave out, but I think the coils had rusted out. Got a new Carrier contractor brand whose brand I can not think of.
If they won't cover it, try to get your (or seller's) money back by cancelling the warranty.
I got all of the above done, but did not renew the warranty. After the cost of the warranty and deductibles it is not a good deal.. The seller had bought the warranty before I bought the house, but it turned out to be a good deal for me. Old house though.
I had a good debate with them on the phone tonight. A manager is supposed to call me back tomorrow. I am not sure who regulates insurance in the state of Maryland .. does anyone know?
From what I've seen and heard, home warranty cos. for the most part are not worth it. I've got a customer who had a bad water heater, warr. co. turned down claim due to the homeowner not draining and cleaning the tank each month. Who has ever done this? What idiots they are.
