Default Handgun in a Vehicle in NC, what is the real law?

I have searched all over the net, and there doesn't seem to be any site out there willing to come up with an official verdict, not even any of the NC state government sites. The following link is the closest thing that I have found, and even it makes it sound as though this or that MAY be legal, but it might not be, just depending on the circumstance. Even the CWP laws are fairly vague.

I've got to say, this past hour of searching has made me very thankful that SC is very reasonable on this one. Here it is legal to have a loaded handgun in a glove box or console state wide. No local government can make any laws concerning guns that are more restrictive than those set by the state.

I am heading up to Asheville in the AM, and definitely like having my 9mm handy when on the road. I've got my CWP, which makes it legal to have it on my person, but that is sometimes less than desirable in a vehicle, especially a full size gun.

Does your CWP carry over to NC? Without a CWP you can carry a hand gun in your car as long as it is visible. It can be in the glove box as long as it is locked in the glove box. It can also be carried in your trunk. I think the biggest thing is to inform an officer you have a gun in the vehicle if you are pulled. I do not have a CWP but I do transport my gun and this is what I do when stopped at a traffic stop.

I have the ccp and I do carry at all times in the vehicle. I know that NC honors SC. I have recently been pulled and I had two weapons concealed and one of which that was on me. I informed the highway patrol officer and he never asked to see either of them but I did present the permit with my driver's license. I have also talked to other law enforcement agencies and they have all said the same thing, just let them know up front and don't try to hide it. Hope this helps.

Yep without a concealed permit as long as the weapon is in plain site it is fine in NC, no matter if it is laying on the seat or on your side. mbfishing a concealed permit in NC only covers a weapon concealed on your body, not in your car.

Heres a good link for gun laws throughout the country....but as for NC, Ive heard what was said above (if you DONT have a CWP) you have to carry your weapon OUT in the OPEN in NC, on the dash is what Ive always heard.

Carried for years before CC permits and just put the gun on the dash in plain site when stopped. Never a problem. Now I just do as said previously...hand them my CC permit. If you go to the NRA site or just google concealed carry reciprocity, you will find a list of states that recognize each others' permits. You can carry anywhere I care to go with a NC permit these days.

From my understanding ...yes, you can carry and unconcealed pistol anywhere that the CC permit allows you to carry concealed. I expect you'd get run out of some businesses though.

Be careful with locking it in the glove box. While it is widely accepted as legal, it has never been confirmed by law in NC.

N.C. has a law on the books banning 'going armed to the terror of the public'. Basically, running around with a gun scaring people.
Yes, you can carry open/unconcealed in many places, however if you do so, and are asked to leave the premises, you should do so immediately.
Get the CWP. A couple of classes and some range time. Well worth it, plus the NC permit buys you something like 38 other states who honor NC permits for CCW.

Locked in a glove box is fine, as long as it is locked with a key. The best way to keep the gun is in the locked glove box unless you have a ccp. Think about it as a police officer see's it. If you have the gun in your vehicle within arms reach, and a police officer can't see it upon his approach to the vehicle then you are busted. I know some people on here are going to dispute what I say, as each person will read into the law differently. I have at least 4 cases pending in court now where people thought they had a ccp and all they really had was a permit to purchase, and we all know you give that to the dealer when you buy the firearm.

Not necesarily true...It is kinda up to the law enforcement officer and then ultimately the judge. This website is helpful

Just remember too that in NC your CWP is attached to your drivers license, so if you are driving "your" car and are pulled over the LE officer already knows that you have a CWP so you definitely want to tell him if you have in the car, even if you don't have it, you may also want to tell him that as well.

Go to the North Carolina gun laws online and read page 21 ! According to the information printed on page 21, there is no clear defining law on carrying firearms in vehicle's in the state of North Carolina! That page says firearms must not be concealed in vehicle's and if carried in a vehicle the firearm must be in plain view at all times!

This seems to be a confusing issue to many, and you would think our wonderful legislature members would make a law clearly defining what we the law abiding public can or cannot do with transportating firearms in privately owned vehicles or any other vehicle for that matter!

Maybe we the public need to write or contact our legislators on this issue and ask them to support such a law, and in fact make one for the sake of the law abiding public! Criminals will always have guns anyway, so such a defining law won't matter to them at all!

I would bet that most people do not know that N.C. law governing boat ramps in our state clearly defines that its illegal to have a loaded gun while using boat ramps in N.C.! That law might well not be inforced but it could get a person in trouble for not knowing the boating laws in N.C. They are also online,,read them for yourselves!

Go to the information that is provided online and read the N.C. gun laws for yourselves, never believe hearsay from anyone! Over the years I have found that most people don't have the foggiest notion about laws in their home state or any state! Even some law enforcement officers that I have talked to don't seem to know at times what the law says about certain issues in our state!

Its always best to do a little research and see what the LAW says about firearms in N.C. for ourselves! Anyone can be wrong about any law,,myself included! All I have to go on is what is posted online about N.C gun laws which will hopefully keep me out of trouble!

If ya think about it, that's a pretty legitimate law.

I don't know the law but I have been pulled several times and had a gun in the center console. Every time I told the officer that I had a concealed weapon and had a permit. Only one even asked where it was.

Hey SeaHunt82, what do the firearms laws in Virginia say about carrying guns in vehicles? I know S.C. has a very good defined law, I lived there for 35 years! Long arms, rifles and shotguns in vehicles in SC did not have to be concealed, handguns did, either in the trunk or in the console or glove box. I never had a LEO ask me in SC if I had a handgun in my vehicle, lots of times I did! I had a state trooper in SC tell me years ago that he stopped people every day that had their handgun plainly visable in their vehicle which in SC is unlawful but he told me he never took exception to it even though he could have confiscated the handgun on the spot and arrested the driver! He also told me other SC troopers did not see issues with handguns like he did and it was best to abide by the SC gun laws!

I guess in NC a firearm in a vehicle is just that, a firearm! I carry a rifle or shotgun at times in my vehicle here and have never been confronted by a LEO because I happen to have a gun with me! I can't see any law abiding person been harassed or confronted by any LEO for carrying a gun in his or her vehicle as long as they are not a convicted felon, whether or not they have a concealed carry permit as long as the gun is in plain view of the officer! Why should I have to tell any LEO that I have a firearm on board as long as he or she can see it?

I have known many people in the past in both NC and SC that carried pistols concealed on them every day without a CCP of any kind! Thats up to them, I don't do that and never have! I believe in the second amendment but I also agree with sensible gun control laws! I don't have a problem with any law abiding citizen of this country carrying a gun for protection, concealed or not and I don't support laws to the contrary!

I am sure Hillary Clinton will try to add many more useless gun laws to the books when she is elected and she will probably make a good attempt at banning all firearms during her term as president! I won't vote for Hillary but many will!

Time will tell!!!

When I moved here I was a little confused about the laws so I asked a police officer. He told me that it is technically legal to carry an unconcealed handgun in public without a permit, but if anyone around you so much as felt "threatened" by its mere presence, you would be arrested based on the above mentioned law. And if a cop saw you, he would immediately invoke this right himself and arrest you. So practically speaking, according to him anyway, you couldn't really carry a gun in public unconcealed. I guess that's why you never see anybody.

Except in Love Valley, NC.....or around here during hunting season you'll see a pistol or two strapped on.

If you want to secure your firearm in your car, check out this site: http://www.consolevault.com/.

I got one for my Tahoe. It fits inside the factory console. It mounts to the floor with the factory bolts. i\It is VERY secure (unless they steal my truck) and is hidden from plain site. I can leave my Glock 22 (duty issue - I prefer the 27 off-duty) in a Fobus holster inside in a vertical position. This way, I can just reach in and draw.

The only downside is that it uses a key lock. I would prefer a remote switch for quick opening. I put the key on a quick release so that I can take it off of my key ring without messing with the ignition key.
