Default Buying a used boat in TN....

I am looking at a new boat from a seller in TN. I am in NC and the seller is in TN. He says that there is NO boat title in TN as well as NO trailer title in TN. I know boat titles here in NC are optional, so that doesn't concern me. I thought all states required trailer titles. He says that in TN they don't even have to have license plates on their boat trailers? He says the boat is financed through his credit union through the State of TN. He is a state employee. The credit union says all that he has to do is do a bill of sale. I figured there would be some kind of paperwork the bank would hold as colateral unit the boat is paid off? Anyone else have any experience with buying or selling used boats in TN? It isn't that I don't trust the guy, just want to make sure before the certified check is handed over....

I lived in West Tn. until about four years ago. When I moved private boat trailers required no tag. However, I'm sure that the boat I owned had a title.

I'm a resident of TN also and do not need a title for my boat trailer or boat. Also active Military but I don't think that matters. Does save me on personal property tax in Carolina though.

No boat trailer titles in Tennessee. To register a boat requires a bill of sale and the boat's prior registration.

Ok, all that makes sense and is consistant with what the seller has told me. Without a title, what does the bank hold as collateral? The seller does still owe on the boat. What forms/paperwork other than a bill of sale do I need? What will the bank give me that shows that the boat is paid off?

I think I would want to talk to a loan officer at the bank that he owes. Get it straight from the horses mouth.

The guy is telling the truth. There is no title for boat, motor or trailer in TN. The boat hull is "registered" with the TWRA (TN Wildlife Resource Agency) and a wallet type card is issued. Plates for trailers are not required either. TN is on a short list of states than do these things, but not the only one. I don't know the form number, but there is a form filled with the clerk of court for that particular county that records the lien. Find out what county he is in and get in touch with the clerk of court. You might want to get a notarized statement from the lienholder stated than the lien has been satisfied to protect yourself.
