Default Breaking News -- FLORIDA NET BAN OVERTURNED!

Breaking News!

Leon Circuit Judge Jackie Fulford rules that the Florida Fish and Wildlife Conservation Commission stop enforcing the state’s Gill Net Ban and dismisses 18 years of litigation regarding the Constitutional Amendment limiting marine net fishing. Florida fisheries are once again being threatened by gillnets. CCA Florida is intervening in the lawsuit and we need your support and donations now more than ever!

That's a lower court ruling in a sparcely populated county (other than the city of Tallahassee) that is heavily populated by old Florida cracker families, and a good number of commercial fishermen - a ruling by a judge who every time a commercial fishing question has come up, has ruled in favor of the commercial fishermen. And every one of his previous rulings has been overturned by a higher court.

He's a she and the ruling is a big hit to the recreational fisherman. It's expected to be overturned but in the meantime it's game on for the net fishermen...

Does anyone in the know on this have an idea how long it takes to get the issue in front of a higher court? Those inshore gillnetters can do a ton of damage in a short amount of time.

Between this, the Okeechobee polluted water releases in certain parts of the state and the proposed major expansions to no fishing zones, 2013 has not been good to the near shore recreational fisherman in FL.

If gillnetting has been illegal wont the FWC have to come up with some sort of permitting that has to be done in florida in order to gillnet like other commercial licenses once again? Or can anyone just go out and start gillnetting?

Anyone wanting a bit more info on this latest challenge to the net ban (legal and other challenges to this amendment began the moment it was passed a bit more than twenty years ago....) should go to the Florida/Georgia board where the same topic is posted. You might want to crack a cold one if you really want to read everything currently being posted.....

Don't jump to conclusions.

The FWC is NOT necessarily your friend. Gotta neighbor who's a commercial fisherman..VERY intelligent guy. Apparently there are a couple really big commercial fishing companies who have the FWC managers in their pockets. He admits there's yahoos out there who will exploit the issue, but there's ways for the conscientious guys (commercial fishermen) to retaliate.

Don't believe all the fish counts and statistics. The accounting system is flawed. GIGO.

Sure, it's a potential setback, but the FWC brought it on themselves. And whatever you do, DON'T believe what you read in the paper or see on tv.

The issue is that there is a conflict between the Florida Constitutional Amendment that bans gill nets and the law that the FWC has been enforcing. FWC enforcement has actually allowed nets with a 2" stretched mesh, which is the conflict with the Amendment. The judge has ruled that since the laws are in conflict a "legal absurdity" has occurred and therefore neither the Amendment nor the FWC version of the law will be enforced until some correction is made.

It occurs to me that it would have been much easier to say that FWC enforcement was wrong, and require that the ban be enforced as described in the Amendment, but I'm not a lawyer and I have no idea what "arguments" might have caused this judge to reach her decision.

Before any of you guys even knew what salt water was, those polluters were already fishing and some how there was a connection to one of them that got you interested in protecting the planet a.k.a recreational fishing, but go ahead be selfish have the entire ocean for yourselves.

but when there's nothing left for the commercial fisherman to do and they get convinced that it was all good for mother earth and joint forces with the environmentalist and ban all and any boating and fishing activities, don't come back and ask for help, because there's not going to be any.

there is a movement trying just that right now, you will need a lot of money and power which most of us will never have to be able to get in the water, you don't think so? ask the Cubans how are they doing with all that water around them and how often are they allowed to get on a boat and go fishing.

the same as when Vinny Lopez told me that there's a beautiful forest right here in Big Pine Key with natural Orchids, when I ask where, he told me that I couldn't go there, but he would be nice enough and deputized me and my son so we can see the wonder that we have on our back yard other wise was illegal and I would get arrested it I was caught going there on my own, socialism at is best, getting closer every day with the help of those who will be sorry about their selfishness.
