Default Abandoned boat without title ?

Hi and Happy Holidays.
Boat yard has an older boat that has been abandoned, needs work and the boat yard just want to give it away, but has no title. I have been told the owner has died. Boat has been sitting for five years out in the weather. Anyway of getting a new title, boats in NJ

In WV the marina can file a mechanics lien with the DMV and serve notice then receive title. It will probably be a similar deal in your state. You may want to post on the legal board and see the resident lawyer can figure out the paper work.

I'm not too clear on the exact procedures but the marina will have to have some proof of billing or storage contract, to show it came into their hands legally. Since the boat was not abandonned at sea they can probably pursue it in regular court. A large part of their case will rest on their declared terms for storage and their attempts to recover those costs and any repairs.

I suppose you can buy-out their interest in the debt and pursue it your self. If there's a challenge though, I'd expect a jury to be less sympathetic to a speculator (no offense intended) than to the original debt holder.

They shouldn't delay much more because after 7 years abandonned property is supposed to be taken into custody by the state. You would then have to fight the state for it.

I'm not a lawyer but in college my business law courses were heavy in "bail" procedures.

Does that boat even have a title?
In NY old cars never had titles-just
registrations.
If you want it and it's cheap take it!
You'll have all winter to get the paperwork
done!
Is this a wood boat? I grew up with a wood boat
and they're alot of work!

In NJ it will be a major PITA. You must get a title from the previous owner. I know of a couple of people that have gotten free or cheap boats and can't get a title or registration from NJCMV. The previous owners don't want to hear that they now have to go get a title for a boat they do not own. Do not buy/take a boat in NJ without a title.

Boat titles in NC are administered by the NC Wildlife Resources Commission. NCWRC has a procedure for abandoned boats that involves law enforcement checks and documented attempts to contact the prior owner. Then, they will issue a clean title...

i bought an old trailer and filed an "application for title" in massachusetts.....it was no big deal at all.....also had an ancient aluminum skiff without a hull number.....they simply gave me a new one and told me to write it on the transom with a magic marker.....i'll bet if the marina sold it to you for one dollar with a notarized bill of sale you stand a good chance of making it happen fairly easily.....perhaps a well written, notarized cover letter from the marina identifying the previous owner and explaining the circumstances of the sale would help as well.....

You could contact the agency in your state that registers/titles boats and ask them what to do.

Some states don't require titles for boats, and some states didn't start titleing till a certain year, in PA I think it might be around 1986. You might check a couple other states out to see what they require, many are very lenient, sometimes it's only a bill of sale from a previous owner. You may be able to get a bill of sale from the marina, or heck, get your buddy to right one up for you. Then register the boat for one season in the other state, and then the next year transfer the registration to the state you live in.

In Virginia, the person/business on whose property the boat is has to file affidavits with the state. If you have no previous owner name, you have to post an add in the paper for 3 days, wait 30 days for a possible response, then if nothing the state sends a new title! I did it last year for a old Whaler...very easy. Virginia has go-by affidavits and forms on-line.
