Default Damaged Dinghy- What Can I Expect For Restitution/Damages?

I have a 2006 10' Lund Jon Boat that suffered some damage. Basically both sides and the stern received damage when contact was made with my boat on the Town storage rack.

The intent is to settle out of pocket vs. insurance (unless you tell me otherwise) and what should I expect to recover for these damages?

There are too many variables to answer that question.

1) What/who made the boat come in contact with the rack?
2) Did you sign any waiver/release or some other type of contract when making arrangements for the boat to be beside/on the rack?
3) Who secured/placed the boat there originally?

If someone steps up, accepts responsibility and offers to settle, I would expect cash replacement value.

Unless you know who hit it and can prove it, I wouldn't expect anything.

If someone accepts responsibility, you'll have to get an estimate of the repair costs or find the value of the boat at this age and its former condition.

Boat looks totaled so I would say your owed market value to replace it. Hopefully someone is taking responsibility.

If you have someone taking responsibility I would look at Ebay, find another one and have him buy it for you. That thing is totaled in my opinion. I know you could bend the metal back, but FK that. It was in good condition before this. you dont need to look at that damage forever....

Bass Pro Shops sells a 2010 10' Tracker brand jon boat for $579.

I don't know if it's the same quality as a Lund.

What you can expect is whatever you are able to hash out with whoever accepted responsibility.

Otherwise you could take them to whatever your state's version of small claims court is.

To All who have offered their insight....one last question who gets the damaged boat should the agreement is for a replacement boat?

I guess I need to get my boat to the upper rack?? old bottom of the barrel hypothesis is proven?

The other guy gets the damaged boat if they replace it. Unless they don't want it.

Bruce , You still have not revealed who you wish to recover damages from and underwhat circumstances. Owner of dinghy next to or above yours you blame due only to proximity? Vandals? Town?

Certainly nothing could be expected from the town as these racks are generally provided for your convenience and to be used only at your own risk similar to parking your car in a marked space on a town street. No written waivers needed.

Has someone acknowledged they or people they are responsible for caused the damage and offered to pay?

Witnesses saw someone else causing the damage but that "someone else" is not admitting liability?

Can/will you supply some details to clarify the very obscure?

I have a really hard time thinking an auto body man couldn't bang that out like new. Now, could/would he do it for less than $370/$579...I don't know.

But suing for new boat...seriously?

And insurance for a $370 boat?
