Yeah......just cut your losses and buy a new boat. I would be upset that my boat was damaged due to the neglegence of another. But unless the guilty party came right out and offered to compensate me I wouldn't even think about chasing down a resolution.

Scrap it for the 50 bucks and buy a new boat for 500 bucks and find a safer place to keep it. The frustration and time wouldn't be worth the 500 bucks to me.

Man you could take that to a Metal Shop and they can beat those places back out and it would look practically new again!! I had a buddy run my 14ft Duck Boat into a tree two years ago and we beat it out and welded in a thick plate in the front to bounce off rocks and stumps!!!

If the insurance company of the person/company pays for the damage/boat the old boat will become property of the insurance company.

However if this were me and someone did this to it and confessed they did it this is what I would expect. I would expect them to pay me for the fair market value of the vessel and any cost that were accumulated by fixing the issue. Also, if I were the person that broke your boat I would give you a 6 pack on top of all that.

However, if you do not know who did it do not hold your breath on anyone fessing up or taking responsibility because in this crazy topsy turvy world we live in MOST people are just rotten dirty scoundrels and are not worth the cloths that wrap their sweaty worthless sacks of guts.

Good luck on your problem though. Hope you get whats owed to you!

Yes. I wouldn't accept a boat of that cost range with that kind of damage repaired and neither would you. Problem in a small case like this is applying analogies like your damaged car scenario. This is not a car...it is a much smaller ticket item. Where I live the vast majority of people would buy this guy a new boat....of course that is a dying breed of people. Be sure and figure it out to the last cent and make sure he doesn't get ANYTHING more than he deserves from the guy busting his boat. Come on....we are talking about the difference here of maybe $100 (then you scrap the boat for $50 and the difference is cut in half). Is it really worth $50 to not just do the honorable thing and buy him a new one???

You can cut the last three feet off the boat and weld a new transom on very cheaply. After painting the total cost should be less than 100 dollars. It would look brand new and the only downside is you'll lose three feet of boat!!

From looking at the standing water I'm guess you had some tidal flooding from the storm. The waves beat the boat back and forth and thats why you have damage on both sides. I don't see how someone would hit your boat one way then come back and hit it again on the other side.

My point was (and is) that he is not owed a "new" boat, just the depreciated value of his boat. Or an equal value replacement. And if there was any prior damage, that would be deducted from the value.

He cannot expect to come out better because his boat was damaged.

Seriously? If the person responsible for doing the damage is stand up, he will replace it. We are not talking about a new Grady or Whaler. Get him the same boat or one that is mutually agreed upon.

Seriously. All he or she owes is the value of the property that was damaged. In this case, a three - four year old boat.

I don't see standing water, but I do agree with the both sides & storm damage statement...If indeed it is storm damage, it will be hard to get money from Ida...Unless it was insured, and the deductible was next to nothing...What are we talking about here guys ?

The OP needs to let us know what "exactly" the damage is from

I think this post was a JOKE. Seriously sue over a John boat... I would be embarrassed to bring it up. Also, I am pretty sure a hammer could fix this. IT IS A JOHN BOAT. If it was a Viking, Merrit, Rybovich, hell even a Grady White or Proline I could see seeking restitution but a JOHN BOAT.

I like the idea of cutting three feet off of a 10' boat- then you have a nice bathtub cruiser!

Again, seriously, it should be replaced. Reread what was written and you will see that the word "new" is mentioned before Grady and Whaler. It should be replaced with the same model or one mutually agreed upon. Craigslist is loaded with john boats and other aluminum skiffs right now. It is the right thing to do.

Better?

I think you are entitled a boat of equal quality and value. I see your boat is a welded Jon, a Bass Tracker riveted Jon is in no way equivelent. When getting the replacement make sure you are getting the same gauge welded aluminum hull. For all the jokers laughing about a Jon boat, I'd bet they'd be crying bloody murder if their boat was damaged. The guy paid good money for his boat, all he wants is to be made whole again. He never mentioned lawsuits or wanting more than the boat is worth.

Unfortunately it wasn't a joke, nor the mighty storm surge within Buzzards Bay and it certainly wasn't jack the ripper (sorry my joke) Damage was done on a haul out, responsible party is working towards resolution. We'll see

Bruce, if you could give us a few more details on how the damage occured, I know that personally, I would be most appreciative. What haulout? Your Jonboat? The boat in the rack above? How was the haulout handled? Crane? Pneumatic winch? Type of straps used? Etc. Etc. Etc. Details could allay a lot of the questions readers may have, including me. I have my own theory of how the damage was incurred, but would rather if you offered more in the way of an explanation beyond "damage was done on haul out". Thanks for your help.

I am carefull with my boat and when they put a fork through the engine cowling I was upset. But I think my merc engine cowling cost more than a john boat. I am not trying to be rude but really... bruce h you are messing with us right?
