hello everyone, and those afraid of first posters don,t be! we ordered a 2002 sea pro 220cc at the ny boat show in jan.. after numerous supposed delays we sea trialed the boat a couple of weeks ago. we did not like the way the boat rode or the time to plane as well as numerous rattles and other deficiences. oreder was written " DEPOSIT REFUNABLE SUBJECT TO SEA TRIAL" WHICH WAS UNACCEPTABLE! UPON decline of sea trial dealer refused to refund deposit , WHAT CAN I DO! PLEASE HELP!!!!!!!!!
On what basis will the dealer not refund your deposit?
I would write them a letter carefully detailing the events as they occurred chronologically up until you verbally requested a refund, request a refund in writing, and indicate to the dealer in the letter that you are cc'ing your attorney, the Office of the Attorney General Consumer Protection Division, the Better Businees Bureau and/or what ever consumer protection agencies exist in your state that actually handle these types of issues (here is where you have to do some home work)and that you plan to follow up with them directly to file claims, complaints or whatever, and then acutally cc all of those agencies at the bottom of the letter providing their addresses and the name of a person you have hopefully already spoken to there.
All that information in the letter will usually show the dealer that you are very serious, have done your homework, and are not some cupcake-- they will blink. If they don't--proceed with all of the above avenues, most of which will cost you next to nothing short of actually reatining lawyer and having him actually do something, but you can do most of this on your own.
Learn your rights, knowledge is power, stick it to them. In Massachusetts knowlingly violating consumer protection laws entitles you to 3X your amount rightfully due--that fact usually causes dealers to blink when they are playing games...
If you have any lawyer friends, have them write a letter. Once the dealership see the law firm letterhead, they will refund. I don't like lawyers, but their letterhead does seem to make things happen.
You kidding me??? IF the dealeer is in NY, PLEASE, by ALL means, post it here or Email it to me, I'd LOVE to join in on the FUN of paying them a visit!!!

Ditto what Dragoon and Mashed Potatoes advised. Also print out the posts that you make here and the other site. I would also look for a few other boater related sites and post the same there.
Than contact Sea Pro directly, tell them your problem, and show them the posts. If they care about bad publicity, they should put pressure on the dealer to do the right thing.
