My apologies to the MODS if this is out of line, or in the wrong forum, however...

Anyone in the Hampton Roads area know of a good divorce attorney? My soon to be wife needs to get divorced, separated for 2 years and the soon-to-be ex won't sign the papers. There is a custody issue, and I want to hire an attorney who has no problem cutting this guy off at the knees in court. Any recommendations?

I don't know the Hampton attorneys very well, but was there a separation agreement that defined custody? Seems like that would have already been worked out for the kids. Va normally states one year legally separated and it becomes final. Yes, both have to sign, but sometimes one party doesn't want to. There's really no legal basis for it though....other than to drag it out and make the other party miserable!

I could make a phone call or two and get u a couple of names. I hired most of them in Richmond when I got divorced a few years back!

I know one who is good and only represents women. She doesn't care if your helping with the attorneys fee's though.
I know shes good because my attorney was up against her in my divorce. Shes a real PIA and a fighter. I would have paid double to get an attorney to fight half as hard as she did.
Her name is Rita Ros Planas
I know its hard to imagine......Just keep in the back of your mind that if things don't work out between you and your soon to be wife (in the future) and she hire's Rita your really in for it! So use caution!! I'm telling you this from experience! :o

Yep, a written seperation agreement was hashed out with her previous attorney, who now has a hard time even returning phone calls. Now he refuses to sign the amendment (even though he agreed to it in mediation) so we can't get to the actual divorce part yet. It's been six months now waiting on him to sign the amendment:banghead:

This sounds like my kind of attorney. Will be giving her a call monday:thumbsup: And thanks for the warning! I imagine if you remember the name of your ex-wifes attorney, then said attorney is pretty damn good!

I'll go ahead and be the devils advocate here as I speak with three of these under my belt. Before you get hitched, HAVE A PRENUP AGGREMENT SIGNED AND NOTORIZED. Have a different notoary witness each of yours signatuure so she cant ever say she was forced to sign under duress. And please dont tell me that the two of you would ever do each other that way. Like I said, I have three under my belt.

Sue for divorce on the grounds of abandonment....he's been out 2 years. That should do it. This is Virginia, right?
